<description>&#60;p&#62;@MrsRcCar:  I have found that you can get out, but usually they charge you a fee to relist or find someone knew, sometimes it is just a fee to get free.  Did you check mention of subletting or breaking lease in the lease?  Where I currently live you have to find someone usually, to take the lease over but they sign a new lease.  My new place lets you leave with just a fee because it is a very regulated building.&#60;/p&#62;
&#60;p&#62;People die in my state if they don't have AC, and it isn't healthy over 78.  Not to scare you, it is usually the elderly.  But I wouldn't hesitate to send an email with strong words because it really is a health issue.&#60;/p&#62;
&#60;p&#62;I am sorry!  Are there any law clinics, do you have an attorney?  Tenant advocacy can help!  I know how terrible it can be to find out a place is unfortunate!  Look over the lease and see if you can identify any specific ways the landlords are not holding up the lease and document!

<description>&#60;p&#62;You'll want to check your state's laws. Typically, a property manager or landlord cannot charge more than 1.5 months rent for breaking the lease. I say check your state because open landlords will create their own rules, but that doesn't mean it's legal. Deposits cannot be used towards rent or breaking the lease, but they have to fairly honor the deposit (I'd take photos of every room to prove you leave it in good shape). &#60;/p&#62;
&#60;p&#62;I would not try to get a sublease or anything like that. Give 30 days notice, give the lease breaking fee, and cut your losses.&#60;/p&#62;
&#60;p&#62;Eta: I would definitely seek help from a renter's advocacy group. If your landlord isn't meeting their side of the lease, I'm not certain you're liable for charges.

I am guessing documenting each interaction with management and what you've asked for is the first step (though I am no lawyer!). Good luck!

We did our walk thru and gave them a list of things that needed fixed or documented for record. None of the things on the list have been fixed expect the stove (that nearly burned down our apartment). Tonight as I type this our AC unit isn't working (and hasn't in over 2 weeks) it is more then 80 degrees in our apartment. They said they will get to it when they can because AC is a luxury item. I am just so over this place. Plus my neighbors take sport in shooting at each other. &#60;/p&#62;

As a former smoker who smoked out on the balcony with the door open, I got an anonymous complaint about smoke smell in the hallway through the property management company. I was enraged and thought it was wussy that they didn't just talk to me, however I installed a rubber stopper under the door to prevent the blow back into the hallway because I wanted to be a good neighbour too. There was nothing that prevented me from smoking in my apartment in the by-laws.

<description>&#60;p&#62;I'm in need of some much needed advice from the wise hive. I live on the top floor of an apartment building. The tenants downstairs are great and we get along fine but aren't social/friends. They are smokers and since we moved in always smoked outside in their yard. Occasionally we would get some smoke smell drifting in but it was rare and they were outside so I never said anything. Ever since the polar vortex, they have started smoking in their apartment. It literally smells like they are smoking in OUR apartment every single night. My husband wants to talk to them. I think we should, as well, but I also feel like it's their right to smoke in their home. Just like it will be our right to have a crying baby at all hours of the night one day. My DH's argument is that a crying baby doesn't affect their health. We just renewed our lease and we truly love both our home and location. &#60;/p&#62;
&#60;p&#62;So basically, what would you do? How would you approach the situation. I really don't want to have any animosity with my neighbors. Sigh. &#60;/p&#62;
