@shellio: I would just tell him that you appreciate his generosity but based on your tax situation you can't accept it and leave it at that. Your income and tax filing information is really not any of your FIL's business.

@MamaMoose: Thanks! My FIL is sure that I can pay my husband an income, which I guess might mean he could contribute if we filed separately and he declared only his income and not mine... but I don't think this would outweigh the benefits of us filing jointly. I am annoyed by the whole thing (although grateful for his generosity) and wish he would just give the money to our kids like I asked him to.

If your husband is a stay at home dad he would be ineligible for Roth contributions if you filed separately (because he would have no earned income), if you file jointly the working spouse can contribute to a Roth for themselves and their spouse provided the total contribution is not more than the total earned income. However if you earn more than 191k then you guys are ineligible based on income.

Any accountant or finance bees or anyone else who can help with this one... My husband is a SAHD and I make too much money to contribute to a Roth IRA. My FIL has been generously contributing to DH's Roth for years but had to stop a couple of years ago because of this income jump. Now he insists that he's heard there is a way that I can "put my husband on my payroll" so that he can contribute to the Roth in his name. This sounds nuts to me and I want him to just put the $ to LOs' college accounts but I promised to look into it. We file our taxes as married filing jointly and already finished them but haven't sent them in until I confirm that he can't contribute, it seems to me we would have to redo them as married filing separately and that is also a hassle. Anyway just thought I'd throw this Q out there since it may help out some of the SAHM bees.
