Unfortunately this is probably correct. Many employers don't allow you to cover a dependent who as access to their own. If they have their own and decline they may not be eligible for coverage under yours. Only way to know if this rule applies is to call your HR.

I agree with @Miss Ariel: - I think your insurance company mistakenly still thinks he's covered by his employer's insurance. It should be super easy to clear up - they just need to contact his previous insurance company to confirm his last date of coverage by them.

@MamaG: yeah I know...I'm usually really good about this. I know his insurance wouldn't cover me if I had coverage, but I don't know why I didn't double check my employers policy.

@Miss Ariel: I will have to see what my insurer says when they call me back/ I call back. I know he's not enrolled in their medical, his portal says "declined medical coverage." Regardless...hopefully he can enroll through his employer if that's the case.

I have a really small office -5 ppl - and this is the first year they extended health benefits to families.

It sounds like your insurance just might mistakenly think he has coverage somewhere else. From what you posted it doesn't sound like he isn't allowed to be covered, but that they think this is his second policy.

Is it possible his employer still enrolled him even though you said not to?

I would think that this would be deemed a qualifying event and he could pick up coverage from his employer.

It's unfortunate that your employer wasn't more clear on the front end. Although, it is becoming very common for spouses to be not covered if they have insurance available from their employer. Both my employer and my husband's do this.

Well crap. My husband's employer offers a terrible costly medical plan and mine is more reasonable and better. Our open enrollment periods coordinated this year, and I put him on my family policy and he declined his employer coverage.

I didn't even think.

Now my insurance is saying he has coverage elsewhere, and they won't be primary insurer.

Are we screwed? What do I do to fix this? No one told me our plan wouldn't cover him if he declined his company insurance
