Last year DH and I were rear-ended by a semi truck, totaling our car and leaving us with a misaligned pelvis (me) and whiplash/ neck injuries (both). It's been a nightmare dealing with the company's insurance and we are appealing DH's case.

I have... i was in a accident 2 and a half years ago, got run of the road because a lady failed to stop at a stop sign so i swerved off into a culvert/ditch that was about 5 feet deep. I was okay the day of, but the next day i knew i wasn't feeling so great. I got xrays done the next day, and was told i had severe whiplash. After 7 months of chiropractic care i got a mri done, to find out i had a bulging disc and disc herniation. I saw a neurosurgeon and talked about all the possibilities to get better. I went to endless amounts of physical therapy sessions and the next option was to get injections in my spine and trigger points which i refuse to do at this time as i am only 25 years old. My neck still bothers me till this day, and Like you i have to be careful with what i do so i don't mess it up even more. So a long story short, i did get a attorney and as of this month the case will finally be settled. I am not getting nearly what i feel is fair, however i am just so over it! Based off my situation, i feel you might get a few thousand if lucky and therefor isn't worth hiring an attorney as they would be taking most of that and the case would be led on for much longer. That is just my opinion from this experience, hope it helps and that you feel better!

I was hit by a car back in 2006, but luckily didn't have to deal with the insurance companies (DH is a PI attorney). I would say without a doubt to talk to an attorney before settling your case...you don't necessarily have to retain one, but there are so many variables that you should explore before you basically sign your rights away. Check out your states super lawyer website and find a lawyer with an auto torts specialty practice and give them a call. Most won't charge you for a consultation and you'll at least have someone review your case details and give you an honest (professional) opinion.

I represent insurance companies for a living and used to handle motor vehicle cases. If you want to talk privately about it more, let me know!

To make it short, you don't HAVE to accept what they give you right away. But, if you don't have an attorney, they may not negotiate with you too much either.

I was in a car accident almost 2 years ago. I was rear-ended on the freeway and had pretty bad whip-lash. This was 3 months before my wedding. I had to go to PT 3x per week (when I totally did not have time for it!) and still had pain on my wedding/honeymoon, though it was much better. Now it only bothers me occasionally, but I have to be careful.

Anyway, the other driver's insurance company is just now ready to compensate me for my injury. It took them FOREVER to get all my records. I have to call them today to see what they are going to do in terms of compensation.

Do I just accept whatever they give me? What's a fair amount? Any tips if you've deal with this kind of thing before.

ETA: Wasn't sure where to post this!
