@MrsTiger: You can use it for bonding time. Technically only the first 6 weeks of my FMLA was for 'birth,' because my doctor released me to work at 6 weeks. The next 2 were bonding, and I've continued to use FMLA over the past year, because it covers FMLA-related events for a year. So yes, you should be able to use it when you become eligible. The 8 weeks might not count towards that. Definitely check with your HR, but that should be the case.

I don't think so, I think you would need to be working for the entire year, those 8 weeks wouldn't count towards it. I know in CT it is 1 year AND 1250 hours worked... or something like that.

Maybe you don't have to take it right at birth. It says "within one year"

But I would assume they would still count the MMLA against the full 12 weeks of FMLA. But it would be worth asking about!

It looks like if you take MMLA first, then the only way you would be able to take FMLA is for the remaining 4 weeks if you were qualified (and you'd have to take it concurrently)

I doubt they'd let you double dip, but you could always check with HR.

@MaryM: Ah ok, I thought there was a version of FMLA for "bonding" not just childbirth. Guess I need to weed through what's out there.

@ShootingStar: ugh...I just looked at the calendar and 8 weeks of MMLA would bring me within 2 weeks of being eligble for FMLA. Maybe baby will just be that late?

@cmomma17: Thanks!

For FMLA, a doctor usually has to provide proof that it's necessary, so I don't see it being possible to use it because you gave birth months ago. I'm pretty sure it has to begin when the medical necessity begins.

Pretty sure they run concurrently. If I remember correctly, MMLA only helps you out if you work for a business that wouldn't have been covered by FMLA.

I don't know anything about MA or MMLA, but at my work (in VA) the FMLA had to be consecutive so 1 day a week for the year wouldn't have been allowed. :(

I just started a job a few months ago, and live in MA. Baby is due in January, and I won't be eligible for FMLA until March (1 year since my hire date).

I know that in MA I can still take 8 weeks of MMLA since I'll have been here at least 3 months by then, but I'm wondering if its possible to take the 8 weeks of MMLA immediately after birth, and then use the FMLA once I'm eligible? So maybe I'd go back to work at 8 weeks, work for a few weeks, and then either take more time off all at once or even just pick one day a week to use as unpaid FMLA for the rest of the year?

Leave is so confusing!
