@wonderstruck: yep, the company I work for had a restriction for four (4) years if someone had a no-fault claim. We wouldn't insure them. We still have a restriction even now on people we think may actually live in your state. Now I see why!

@Mrs. Lemon-Lime: Michigan. Sucks because your insurance can go up whenever there's an accident, even if it wasn't your fault. I hate it!

@brownie: Ohh gotcha - I live in a state with no-fault insurance, so I forget about people having to deal the other car's insurance company instead of their own! I'm glad you're replacing it though.

@wonderstruck: It's not my insurance it is the other cars insurance. We are going to fight it because it is worth it to. Everything I read says that we should replace it. Going to look for new carseats today. It just changes all of our plans. This one was going to expire next year and my son would be 4 and we would buy a forward facing to replace it. I'm not ready to forward face him yet so we are buying a new convertible. Then we decide if we extended rear face him or forward face him in a year.

I've heard of people getting their insurance company to change their mind on this one, because even if the car seat wasn't occupied and your car was parked, it still could have been hit hard enough to cause internal damage to the seat. Problem is you wouldn't ever know it until you get in an accident with LO in the seat and the car seat fails and doesn't protect them properly. A lot of insurance companies will end up caving on this one when you tell them that your car seat manufacturer says that your seat needs to be replaced, and that you can sue them if they refuse to replace it and the seat fails and causes injury to your child in a future accident. That's what the people I know who were in this situation said anyways, and it worked.

I'd call the car seat manufacturer and let them decide if it needs to be replaced. If yes, get a statement from them and provide it to the insurance company. It should be covered by them.

Yep, I heard it can be a pain to get it replaced by insurance, but they do not determine if it needs to be replaced, the manufacturer does. I have heard that a lot of people have to have a statement from the manufacturer sent to the insurance for it to be covered. And by the standards of the National Highway Traffic Safety Admin it would need to be covered because it was the door nearest the carseat was damaged. (their criteria is in the link in my last post). I would totally fight it! And if they still refuse I would even ask for a written statement from them saying they will take full responsibility if the carseat fails in the future.

Almost all seats sold in the U.S. are absolutely recommended to be replaced after an accident. You can call your carseat manufacturer. It's not up to the insurance company.

According to carseat manufacturers, there COULD be damage. The crash could have compromised the integrity of your seat. There would be no way of knowing until the next accident, which is why they should be replacing it. I would fight this!!

Grr, now insurance (the other vehicle) is saying it doesn't need to be covered. So if anyone in California ever needs it, here is the applicable vehicle standards that says "in use" (what they are trying to say) OR damaged.

I agree that you should check with the car seat manufacturer. If in the case it does need to be replaced your insurance carrier should cover the cost.

I would call the customer service line for your car seat, they all seem to have different definitions. If they don't give you a satisfactory answer try your insurance company.

My car was parked and hit by another person. There is a visible dent in the door but it isn't "bashed in". It was the side and the door that the carseat is on. The car seat is in a captain's chair.

Is this considered an accident and do we need to replace the carseat?
