So we opted to buy a new cell phone. I started looking for one identical to the one that drowned. DH didn't like my options so he found one on his own. We bought it then before it shipped I noticed that it wasn't equivalent in speed (not 4G). I mentioned this to DH and he said he was fine with it anyways. The phone arrived, he got it setup with our carrier and then realized the speed wasn't 4G. His remark after telling me this "new found" information was that he would take my phone and I could have the lesser one since I don't need the speed anyways (um, no deal). Now he wants to get a different phone but the place we bought it from won't allow a return because he opened the box. UGH, if he would have listened to me and thought about the speed thing before it arrived we wouldn't be in this position.

Sorry, just needed to vent.

I would buy a new phone. A few hundred dollars is not worth the strain/drama.

I would definitely not ask your cousin to claim it under her insurance. Based on the details you've provided I don't see how your cousin is at fault in any way in this situation so it wouldn't be fair to ask her to have her insurance rates go up. As @prettylizy: said if you can claim it under your homeowners your rate increase will likely be more than the cost of the phone over time. I would just buy a new phone.

i would buy a new phone or claim it under your insurance if its not a hassle.

I wouldn't ask your family member to claim it under his/her insurance because that might cause tension.

I'm glad your DD is okay and thank goodness for your husband's quick thinking

I agree with just buying a new phone. Accidents happen and this isn't worth starting family drama over for years and years to come.

I agree: Buy a new one. A few hundred bucks (or more) isn't worth the rate hike that you'll get if you make a claim, or the strained relationship if you ask your family to cover it.

@foodnerd81: DD was absolutely fine and wanted to go back in the water shortly after it happened. However, we made sure that an adult was actually in the water whenever she was and we ditched the floaties. I won't point out to DH (because it is such a sore point with him) that the floaties probably helped because without them she would have just sunk, with them she was at least bobbing up and down.

Yep just buy a new phone. Not worth the time/trouble to blame anyone. What a bummer though :(

That sucks-- but in the long run, it's just a phone and your LO is safe and hopefully not scared of the water. I would just buy the new phone. I don't know much about the insurance aspect of it, but I definitely wouldn't ask the homeowners to cover it. Frankly, if it were me who had jumped in, I'd be annoyed at myself for having the phone in my pocket-- anytime I'd be around a pool and my own LOs, I would assume there was a chance I would need to jump in, you know?

Any chance you can buy a used one or something? Or try bringing it back to the store?

Phones and water---- what a bummer!!
As someone who works in home/auto insurance I will tell you this is not the type of thing you want to claim on HO insurance. Even if you can get it covered, this isn't what the insurance is designed for and will likely cause rates to go up more and for longer than what the phone is worth. You (and your cousin) want to save using your HO insurnace for the big things like fire, wind, water and theft.

So, this weekend we were at a family member's house for their son's first birthday party. They have a swimming pool and DD (3yo) was in her suit and sitting on the side of the pool with inflatable floaties on her arms (we don't use these and DH despises them but my family all use them). I was inside nursing DS so I did not witness this but apparently DD fell into the pool and started to panic. My 7yo nephew was in the water and nearby but didn't move fast enough so DH jumped in and grabbed DD. DD is fine but DH was fully clothed including his new cell phone in his pocket. We took the phone apart and put it into a bag of rice for two days but unfortunately it is dead. Now we have to replace the phone and are trying to decide who should pay.

Some friends suggested having my cousin claim it under her homeowner's policy but I'm worried about what kind of tension this might cause. Partly because the birthday boy has medical problems and they are currently in the hospital with him having just had surgery and swimming was at your own risk.
