OK, she just has a micromanager boss and annoying coworkers...nothing she can quit and collect on. She is going to try to work for 4 months and reevaluate the situation...she is almost at month 2!

Yah the employer generally has to pay for unemployment (through unemployment taxes) and so they generally contest most unemployment applications.

I think you can try to get unemployment where I'm from if you quit IF it's for a provable reason (like harassment or unsafe work environment or something)... However, I think it can get pretty tricky going back and forth as the employer can argue their case...

You can collect if you can prove that the conditions you were working under were really bad and you were forced to quit. I have a friend who did that because she could prove that her employers were verbally abusive, etc. But it was really difficult, even though she had tons of evidence to back up her claim. ETA: I live in MA, so I'm not sure if it's different in other states.

I had to quit my job as a teacher in Texas (didn't qualify for FMLA, because I hadn't worked there a year yet) and I didn't get unemployment.

It varies based on where you live I think. In NY, you can collect unemployment if you quit if there is a qualifying reason why you quit. The description of a qualifying reason is vague though.

I don't think she qualifies. I collected after I got laid off in my 3rd trimester. I didn't find the application process to be that bad but you had to keep showing proof that you were job hunting and had report to the state unemployment office for interviews/workshops.

I'm almost positive it's being fired or laid off. And even then, it's a nightmare to actually apply and receive unemployment. I know people who almost a year later are still waiting!

I don't think that she can collect unemployment if she quits. Pretty sure you have to get laid off or fired.

My friend went back to work after maternity leave and she hates her job and misses her baby. Her finances are a little tight but she really wants to resign (or is dreaming about it) and thinks she can collect unemployment for a few months before she looks for a new job.

Can you quality for unemployment if you resign? I thought the benefits only apply when you are laid off or get fired?
