@Modern Daisy: did you get a chance to talk to the director?

I'd be really upset if I walked in and found my kid screaming her head off and no one even seemed interested in helping out. Does your teacher have other helpers who can come in when one needs assistance? I'd be really concerned about the fact that the teacher doesn't seem to care (as you said) and that you often find your child crying. It would break my heart.

The rule at my son's daycare is that the director calls the parents only in the event of a head bumping type of incedent.

@Applesandbananas: I also text with one of the teachers throughout the day as she babysits for us regularly. This is another reason I know they have total access to their phones. I mean I don't like the idea of it, but I"m also realistic and know that no matter how hard you try to enforce a no-phone rule, they will still find a way. Which is why I didn't even try to ban our nanny from using her phone, I just set ground rules as to the safety precautions she had to use.

One of LO's teachers texts me pretty frequently throughout the day, I'm kind of surprised phones are so taboo. Idk if our center or state regulatory body has a rule about it or not.

If it was interfering in her caring for LO or others, I'd be upset and discussing it with the director. Can you also make it known you want to be called if LO has an accident?

f*ck no on the texting while LO is really upset. i can understand if the daycare teacher is tending to other children once in a while, but routinely finding LO extremely upset would really bother me. i definitely think you're doing the right thing by talking to the director.

Oh, yikes!!! I've worked at daycares before and that's definitely unacceptable, especially the phone usage. As for children getting hurt, I had to fill out an incident report and inform the director immediately and if it was "serious" enough (aka not just a fall where they got up and were fine- I had 3-4 yr olds), she would contact the parents right then.

Ugh, in your situation, I would have a pretty serious talk with the director. Maybe try the nanny thing again if finding another daycare wouldn't be possible? This would seriously bother me.

@MsLipGloss: no! But she was not a permanent teacher in the room. She's a floater. I wanted to say something to the director about that. But dh said to give her one more chance. Because we've all done that before honestly and my LO was an extreme high needs baby. And screaming might not be the right word. It was a high tone, loud, exasperated "oh, come on, again!!" referring to LO needed another poop diaper change.
Like I said she's been golden towards LO ever since. And we don't always pick up at the same time.

I was extremely upset at that time and ready to get her fired.

@brownie: I think the one thing the director won't be able to explain away and get defensive about is the cell phone usage. Clearly the policy is being violated and It's not like I'm jumping the gun reporting a first incident, this has happened a few times. I've clearly waited until I've seen it be a problem.

@locavore_mama: Thank you! So, that's exactly how we've been handling it so far (with the teachers) and we're getting the same exact results. We don't even need to say anything to them, they know when they're caught and they make an obvious attempt to improve afterwards. This one teacher though, I really just think she doesn't like working with kids. It's one thing to have an off day and slip, but I think she just hates being around them, lol.

@Modern Daisy: The phone usage--a clear violation of the daycare's own policy--and the director's acquiescence to same, would be enough for me to find a new daycare.

I expect teacher to be attentive to students at virtually all times. This doesn't necessarily mean my kid at all times so occasionally, the kids have to wait their turn. But not their cell phones. And that is truly an issue that you have come and your kid is not being supervised and they are on the phone.

Accidents happen, but you should be given a report. My kid fell one day and hit his lip on a plastic picnic table. He literally just tripped over his feet. Everyone was watching but it was definitely scary. When he was an infant, he had a block in front of him and he was tired so he fell on it and cut his lip. But if they weren't able to tell me what happened, then I would say there is a problem.

It sounds like you are planning to do what you can do. Good luck with the director.

@Modern Daisy: ok so something like that probably wasn't the teacher being negligent.

What if you approached the situation with the director just as a "Hey I noticed my kid seems to often be crying at pick up, I know it's a fussy busy time of day, but several times the teachers have been on their phones rather then address the children when I come. What is the policy on teachers using their phones and is there anything you can do to help with afternoon fussiness (aka more staffing, a snack, distraction activity, better process for pick up etc).

The fact that there's a no cell phone rule but everyone ignores it and it's not enforced is disturbing to me.

My daycare has a no cell phone rule and it's absolutely enforced.

We've had a similar situation with one teacher. The last straw was one day DH came early for pick up one day and the teacher was screaming at LO during a diaper change. She was still an infant at that point and a very fussy one at that. As soon as another teacher saw my DH round the corner she made a noticeable sound to alert that teacher.
We didn't even need to talk to the director and got a call from her that same evening. That particular teacher has been extra sweet towards us and LO ever since.

@PermaStudent: When we had a nanny I wrote in her contract about phone usage. I didn't have a problem with it as long as she was tending to LO's needs first and using a hands free device while they were out and about. I personally think it's pointless to try to enforce a no phone rule since most people will find a way around it. Which is why I made it okay to be on her phone as long as DS was her first priority.

Honestly the fact that everyone just seems to accept that the phone rules can be broken would be reason enough for me to leave the day care. It is 100% unacceptable that your child is hysterically crying and a teacher is texting.

In general, I don't get too upset over accidents. LO has certainly been hurt on my watch so if I can't keep her injury free at all times it's unfair to expect it from her teachers. But given that you already have concerns about the teachers not being attentive to the babies, repeat injuries would probably confirm my concerns.

We were adamant that our day care at least have recorded video (we actually have a live feed which is a bonus but wasn't a requirement). My daughter had one injury at school that I questioned and demanded to see the tape. The teacher was totally at fault and she was eventually fired. I would not be comfortable without being able to get video proof of everything that happens during her day. I also think video makes the teachers more accountable.

The phones have got to go, period.

Accidents happen, and the fact that things are usually ok when you show up unannounced is really good.

But the phones are unacceptable. I get that people can be less strict at times, like if they also use them as cameras (assuming photos are permitted) but texting is unacceptable.

@danda: Haha, I would LOVE to seek another facility or just know that I have that option, but unfortunately there is nowhere else. Yes there are other daycares in NYC, but all of the ones within "reasonable" distance (like an hour out of our way) are fancy montessori type schools and start at around $3K - if you can even get in. Our only other realistic option is a nanny, but we tried that at first and she resigned with no notice which is why we're now at this daycare.

@Modern Daisy: Maybe if enough people report the texting, the director will be more likely to impose some kind of rule, so hopefully it wouldn't be pointless. I know my daycare workers had their phones out on counters and what not but I never saw them with their phones in their hands and I showed up all times of the afternoon.

I made sure she knew I was upset that she waited so long to call, in a totally respectful way. Otherwise though I have complete confidence in her, she's really taken good care of DS through several sicknesses and always calls when there is an issue. I even heard that she yelled at the teachers after the split lip incident and was very upset at them. I don't totally blame them since I think accidents just happen, but I appreciate that she at least cracked down on them.
