<description>&#60;p&#62;No proof required to use the FSa. But when you file your taxes if it doesn’t show both parents as working or attending school the pretax deduction will be added to income and be taxable at that point.  So the penalty is that you will “owe” taxes on those funds since you didn’t have tax withholding on the front end.

&#60;p&#62;Mine is set up to deduct the maximum amount annually ($5000). It’s a pre-tax deduction from each paycheck so it lowers my annual gross. Not sure how it will work this next year, but in past years we still take the deduction for one dependent. Compared to the other deduction that @gotkimchi:  mentioned, I figured that we save about $1,000 a year in taxes so I’m a fan.

<description>&#60;p&#62;I'm pretty sure that next year I'll be going back to work on a very part time/free lance basis. My daughter already attends preschool a few hours a week and I'd need childcare for my youngest. We'd like to use a dependent care FSA but I'm anxious about what type of proof of working/looking for work I'll need. And do I have to make X amount or work the same number of hours we have care for it to count? Has anyone gone through this process recently?
