Nope, but I did not get any mandated paid leave. I had 4 weeks covered by my sick time, and 4 weeks unpaid FMLA. Wouldn't have mattered what my birth was; we couldn't afford anymore unpaid.

I was told I would only get 6 weeks paid by short term disability for a vaginal birth, and 8 weeks for a c-section.

@kjpugs: It sounds like your Dr. will be the determining factor, so whether he releases you to work at 6 or 8 weeks, I would ask him at your next appointment what his practice normally is. I know where I live for STD it is the same thing, when the Dr. releases you to work, and 8 weeks is pretty standard for a c-sec here, but I know of one situation where a woman asked to be allowed to go back to work at 6 weeks and she was.

I know that at my previous job, we went by the maternity leave laws in Alabama (where the company was based) and FMLA ran concurrently. I work for a non-profit, and we are given 8 weeks of leave, with the option for an additional 4 weeks at the discretion of the director. I have signed paperwork stating that I will be allowed to have 12 weeks of maternity leave (I am not covered by FMLA).

I have had two c-sections and was offered 8 weeks with both of them. One maternity leave was in NY and the other was in TX (well would have been, I ended up quitting because it actually saved us money). I thought 8 weeks was pretty standard....

Here you get 6 for vaginal and 8 for csection, 12 weeks if your company qualifies for fmla(but usually unpaid after the 6 or 12 weeks).
@kjpugs: and I totally thought the same thing when I was pregnant with #1, that I'd get more time if I had a csection...and then ended up with one wha wha

@kjpugs: Do you have an employee handbook? Maybe the laws aren't based on your particular location but the location of your employer's HQ?

@LindsayInNY: I'm not sure how that would work since my HR person is at the Indianapolis HQ and I work from home in Florida. What do you think? She said "Again, if all goes well, it’s typically 6 weeks disability for delivering a baby, even if it’s a c-section." and I asked who determined that and she said "Yes, the Dr. determines the amount of time off – 6 weeks is just the standard for a baby. If there are complications, your Dr. could determine that you need more time off." Seems so vague to me! I'll be asking my OB about this next week at my appt of course.

The paid portion of my maternity was through our company's STD plan and was 6 weeks, regardless of vaginal or c-section, complications or not. FMLA was the standard/maximum 12 weeks, which ran concurrently to the STD.

Our short-term disability policy covers 6 weeks for a vaginal birth and 8 weeks for a C-section. I am taking more time than that, but that is what is paid through my company's STD.

Almost all companies pay maternity leave through short-term disability policies they have with an insurance company. I would ask your HR person to have a conference call with you and the insurance rep to confirm the exact details. "Most C-sections" is fuzzy and these things are typically cut & dry!

For me, it wouldn't change the length of my leave but would change my pay structure while on leave. I'm taking the max under FMLA (12 weeks) and can use accrued sick and vacation time to pay for it. Sick leave is only allowed to be used until the doctor clears me as physically able to return to work, which usually happens at 6-7 weeks after a vaginal birth or 8-10 weeks after a c-section. So basically, if I ended up with a c-section, I wouldn't have to use as much of the vacation time I've built up because I could fund more of it with sick leave, but I'm not getting more than 12 weeks off regardless.

I don't know how it works for people who don't get the full 12 weeks, sorry :(

I know NY is 6 weeks (vaginal) or 8 weeks (C-section). I thought it was state mandated, not company mandated?

ETA: Just googled and found out that your state doesn't have its own parental leave laws. #fail

My maternity leave was 12 weeks, 8 weeks of it came from my sick time, the other 4 from my vacation time. If I had a vaginal birth I would still have a 12 week maternity leave but 6 weeks of it would have been sick time and 6 weeks from my vacation.

I'm 31+4 and exploring the details about my upcoming maternity leave. There's no reason to assume as of now my delivery will be anything but normal, but I'm of course looking into all options. I always assumed that I would get 6 weeks maternity leave for a vaginal delivery or 8 weeks for a c-section. That was the one silver lining I saw about having a c-section (I've never had surgery so it scares me a bit.) When I talked to my HR rep about my maternity leave, she said that I will get 6 weeks for vaginal and "most c-sections." It sounds like I get pretty much 6 weeks no matter what :( What was your maternity leave policy like- was it clear cut for vaginal vs c-section? Did it depend on what your doctor "ordered" for your leave?
