<description>&#60;p&#62;@TheReelDeal:  Ok, after an hour of digging.... I think we're ok.  What you're saying is true, but I think the key is that you cannot try to USE both.  Since my husband has a HSA, he cannot use my medical FSA and vice versa, I have my FSA and cannot use his HSA to pay for my medical expenses.  But we are allowed to have our plans as they are set up.  As long as we don't try to use each others FSA/HSA, then I don't think they consider that double dipping.&#60;/p&#62;
&#60;p&#62;From our benefits handbook:&#60;br /&#62;
Note that your spouse/same-sex domestic partner may choose to enroll in a health care FSA through his/her employer and still be covered by a (His Company) HSA Advantage plan. In this case, your spouse/same-sex domestic partner may only submit his/her eligible expenses to the FSA for reimbursement. Likewise, you cannot submit your health care expenses to your spouse’s/same-sex domestic partner’s FSA. If you do, you will no longer be eligible to make or receive contributions to your HSA.&#60;/p&#62;
&#60;p&#62;@travellingbee:  Maybe they can fix it if it was accidental and you didn't elect the FSA?  Or if same rules apply in your case and you are stuck with the FSA, then you may not actually be able to use the HSA money.

<description>&#60;p&#62;@purplepumps: I understand we're you're coming from but this is the IRS  :silly: . They don't want you and your husband both receiving tax incentives. Since a HSA can be used for a spouse's medical expenses even if they are not on the same plan, from an IRS standpoint you should only receive tax relief on one account. &#60;/p&#62;

<description>&#60;p&#62;@TheReelDeal:  Right, but we're not really double dipping cause the limits on HSA and FSA are different for single vs married plans.  Since he has his own HSA plan, his max contribution limit is $3500, vs $7k if I were on his HSA plan as well.  Or $7k combined if I had my own HSA plan too.  And since he has a HSA, he couldn't elect a health FSA.  But I don't have a HSA, so I could have a health FSA max of $2500 for a single.  Once again, vs $5k for couple or two individuals.  So at the end of the day, we're not double dipping cause of the different limits imposed on a single vs couple allowed amount, but they prevent you from doing that.&#60;br /&#62;
I would definitely understand double dipping if we were both able to contribute a full couples plan amount.&#60;br /&#62;
And are we considered each others dependents?

<description>&#60;p&#62;@purplepumps @travellingbee: Unless you are currently in your open enrollment period you can't make changes to pre-tax deductions without a life event (birth of a child/adoption, divorce). I wouldn't worry too much at this point. You'll only pay taxes on the HSA contributions if you're audited. I would be mindful of it for next year.&#60;/p&#62;
&#60;p&#62;You can also put money into an HSA post tax. You just need to be sure not to exceed the IRS contribution maximum.

<description>&#60;p&#62;@purplepumps: Your husband's HSA can be used for your medical expenses and other tax dependent's medical expenses, just like you can use your FSA for your husband's and any tax dependent's expenses, as long as they are IRS eligible medical expenses. That is why the IRS frowns on having both, you are paying less taxes when these accounts do the same thing.

<description>&#60;p&#62;@travellingbee:  I thought this was the reason they had lower limits for single vs married plans.  I had DH sign up for an HSA and put the max in there for single, $3500 and a few hundred in his FSA for dental and vision.  (I think married max was like 7k)&#60;br /&#62;
My assumption was that he could not use his HSA to pay for my expenses since we're not on the same plan.  And I dont think I count as his dependent.  I didn't sign up for a HSA plan so I put money in my FSA for medical and was going to use that for my IF expenses.

&#60;p&#62;A small heads up, your husband can't &#34;technically&#34; by IRS standards have a HSA if you are enrolled in a FSA. The IRS sees this as double dipping and if you were audited there is the potential for paying taxes on the pre-tax money he put into the HSA.

In the past, we've had to pay the invoice and then submit it for reimbursement, but this year we just got a pre-paid debit card thing and use that to pay directly.  I've never had any issues.

It looks like these would be eligible expenses based on what I can find online. Just wondering if anyone else used an HSA or an FSA and if it was simple and straightforward or if there were hoops you have to jump through.
