Yikes. Yes, it's not surgery but it's a procedure that was without parental consent and on the wrong kid! Not good and even more worrisome for larger procedures.

It doesn't matter if a procedure is considered "minor" or whether a patient will suffer lasting damages or consequences (although I'm sure that will factor into the punitive damages the hospital must pay if a judgment is found in favor of plaintiffs). This was pure negligence. A hospital should have better safeguards in place to ensure that mistakes such as these do not happen, or doctors/staff need to be more diligent about following appropriate safeguards.

Lawsuits aren't just about being money-hungry.

I agree with @lawbee11: the Dr. and hospital need to be held accountable for their actions.

I had a frenulectomy when I was 20 while I was having my tonsils out. The ENT clipped it too far back and exposed the muscle causing me to have to get three stitches under my tongue. Healing and eating sucked but I've had no lasting effects.

@lawbee11: I agree. The hospital staff clearly didn’t follow established protocols, or if they did, those rules/protocols need to be changed. What drives change? $$$$$$$$$. Nothing prompts a company to really adhere to the rules like a multi-million dollar fine/lawsuit judgment/similar.

As someone that works in a hospital, and specifically in the quality/safety realm, this is infuriating, unacceptable and completely preventable. It doesn't matter if it was a minor procedure, or if the baby won't suffer any negative consequences. It's complete negligence.

The severity (or non-severity) of the procedure is a moot point. The doctor performed the procedure on a baby without the parents' knowledge or consent, so he and the hospital should be held accountable for that. Without more information I don't think it's fair to say that the parents are out for a payday.

Totally agree with @Applesandbananas. Yes the implications are scary since it could have been something big, but clipping a tongue tie (which the baby probably bad, since so many do and the doctor should have noticed if he didn't) is just not a huge deal. And it's not surgery, the headline is clickbait.

@lawbee11: right? Can they clip something if it doesn't exist?

Regardless - scary. And extremely, extremely negligent.

@Mrs.KMM: I do think that should take a very hard look at their procedures and safeguards though, because next time it could be a circumcision or something more serious

@Applesandbananas: I agree. If the baby did not have at least somewhat of a tongue tie, the doctor would have been unable to clip it. Obviously the procedures to stop this from happening should have prevented it, but there should be no residual damage of any sort to this baby. I think that it is being blown out of proportion.

There are no real implications. I think these parents are out for a payday. Honestly, if there was no tongue tie, the procedure wouldn't have been performed. My (non-medical professional) opinion is that the baby probably had a minor tie.

It's not like a circumcision or something. I agree that it's scary that the safeguards failed, but this seems really blown out of proportion. I'd be curious to see how much they're suing the hospital for. Probably hundreds of millions.

The surgery is minor, but who knows of the implications since the baby didn't need it. I wonder if the doctor paused and looked at the chart/ ID bracelets after seeing the baby's tongue was not tied.

This is completely unacceptable. There are procedures in place to make sure something like this doesn't happen. A time out should have been done. Where was the baby's nurse?

At least it was a minor surgery but wow, the parents must be so upset! My hospital was so careful checking the ID bands for every single little thing, I don't see how this could happen.
