<description>&#60;p&#62;@bees_knees:  Hah no problem. I'm really good at getting people all riled up when they are getting taken advantage of. Also, consider that this, bottom line, is for private gain of the developer of the subdivision. So if the city doesn't want to pay you for an easement, the owner of the subdivision should if they want their projects to progress. None of this is your problem, NONE. If they cut up your land without your consent and without a good faith effort to compensate you, then they all have a BIG problem.  Next step is to call the owner of the subdivision and threaten legal action.   Someone is paying for all of that work, likely the land owner of the subdivision. I'm sure he or she would also be very interested in getting the project moving. Without water/sewer access, his/her project is on hold also (which is again NOT your problem).&#60;br /&#62;

&#60;p&#62;DH called and left a message for someone at the county today to see if they have any standards for easement compensation. We also talked to a family friend who is a long time board member of the electric company here (so has some experience with easements) who said we are totally justified in thinking we deserve some compensation for this, so that also helped!

I’dget a lawyer involved (or at least have one write a strongly worded letter) and wait for their response. Don’t feel bad about holding it up. This is their problem and you don’t have to do anything other than wait for their offer. They should have known to do this at the outset; any delays are their fault.

<description>&#60;p&#62;@bees_knees:  The state has their own metrics - they told us a bit about them, specifically how value is determined (they bring in multiple appraisers and average out the results) but they wouldn't share all the details of calculations. We were presented an initial check (that was ours to deposit no matter what) and then we had the choice to sign/settle or open negotiations. Every homeowner is handling their own, in fact we had to sign a document that said we wouldn't discuss details with any of our neighbors or use their compensation amounts to negotiate our own. &#60;/p&#62;
&#60;p&#62;At this point we are comfortable with the money we were given, or at least we don't feel like it's worth it to fight for a bit more. We are actually dealing with some physical structures that were placed on our property that we feel hinder the use of our driveway and have created a safety issue. As well as some damage to property that was not within the easements.

&#60;p&#62;Unfortunately there is only one neighboring property that has similar impact, and he has more money than he knows what to do with (wish I had that problem!) It’s also farmland (vs our residence) so he doesn’t care as much about the visual impact.

<description>&#60;p&#62;Our street is part of a major two year project - part town and part state. We have been compensated for temporary easements and permanent easements. The compensation has been based on the amount of space, the physical changes to the space, the visual changes to a space, the impact of the change on how we can use the space, and the impact of the changes on the value of our property. They have a detailed calculation for each metric. The part that the town specifically needed was only 4 sq ft but they still compensated us. The state has needed way more easements and we are still in negotiations with them on some things - in our case they didn't need to have a settlement to start the project, but we have a final date to settle with them or it goes to a hearing.

We luckily caught them when they were about halfway through and demanded a surveyor come out—turns out the trees they cut were outside of their easement but further down on our property (the trees they hadn’t cut yet) ARE within their easement so we said if they left those trees untouched we could call it a trade. I keep getting after DH to get it in writing though bc I swear I’ve had nightmares that I wake up and they are all gone. We live in a very very rural area (like, everyone knows everyone—I went to high school with the guy DH yelled at about the trees 🤦🏻‍♀️) and it seems things operate differently here than the rest of the world. Not always a good thing! &#60;/p&#62;
&#60;p&#62;We def won’t be giving any further easement without some sort of compensation—it is nice to hear that we aren’t totally out of line thinking so! So thanks for your feedback! ❤️

&#60;p&#62;Honestly it sounds like you need a real estate lawyer and if you can afford it off look at getting one for both issues.

<description>&#60;p&#62;Typically compensation would be based on square footage and type of easement (temporary vs permanent). The county probably has a dollar value they typically give per square foot. I would guess in your case they need some temporary easement for construction, and then some permanent easement for where the line would actually be.&#60;/p&#62;
&#60;p&#62;I would definitely contact the county though. Where I live, most counties have a full time staff member who deals with right of way and this type of thing.

The county is already on my sh*t list because they overshot their easement (on the adjacent side of our property) by a solid 15 feet and cut a bunch of our trees down last winter  :meh: &#60;/p&#62;

<description>&#60;p&#62;Does anyone have any insight to the granting of easements and possible compensation?&#60;/p&#62;
&#60;p&#62;We live on a 27 acre property which has an existing 30 foot easement on one end of the property. The county has hired (I assume?) a nonprofit water authority to run city water and sewer access to a subdivision. This apparently requires a 50 foot easement--20 more feet than they currently have, which equates to about an additional .75 acres of our property. The engineering company actually didn't realize that they didn't have the required 50 foot easement until my husband pointed it out, and now the woman we are dealing with at the water authority is being a real b*tch and basically trying to bully us into giving the easement. She said that they have never offered monetary compensation for easements, and has only offered us hookups to their system (which we are not interested in as we have three water wells and a septic system)&#60;/p&#62;
&#60;p&#62;Sorry for the long winded description. We don't want to hold their project up but we also don't want to just give up .75 acres of our property just to be nice. [note: it wouldn't just be buried lines, there would be mounds and manhole covers that would forever alter the landscape of our property]. &#60;/p&#62;
&#60;p&#62;Anyone have any insight? We're having trouble finding resources online about compensation for scenarios like this.
