@Mrs. Taco: Oh, that's awesome! It probably didn't work for me because it wasn't a week+ of time - only a few days. I hope everything works out for you that you'll be able to be out for the whole 15 weeks!

@Adira: I found the regulations: "If for some reason the employer’s business activity has temporarily ceased and employees generally are not expected to report for work for one or more weeks (e.g. , a school closing two weeks for the Christmas/New Year holiday or the summer vacation or an employer closing the plant for retooling or repairs), the days the employer’s activities have ceased do not count against the employee’s FMLA leave entitlement."

It's weird it didn't work that way for you? Maybe because it was only the actual holiday, not the whole week? So many exceptions to the rules!

@Adira: Yes! All breaks (summer, Christmas, and spring) don't count towards FMLA. I'm going to put that in the email too just to have everythingggg in writing. It always worries me that someone will tell me differently later on down the road.

@Mrs. Taco: Are you sure you'll get 12 weeks of FLMA after your Christmas break? Ours is based on our last day worked, so even if there's a holiday or something, it doesn't extend our FLMA.

Thank you for all of the feedback!!!

Update: Just talked to HR and the "If you have the 14- or 30-day waiting period and you are hospitalized, the waiting period is waived" clause can be used for labor, yay! So my 6 (or 8) std will start when I am admitted. The lady on the phone was so blah. She just kept saying "yes" and didn't make me feel confident. I am going to send an email so I have it in writing!

If I go until my due date (or close) I'll have Christmas break, 12 weeks FMLA (6 covered under STD), and spring break, I'll be at home for 15 weeks. Then I'll go back for 8 weeks until I have the summer off. I think I may like this better than my June baby! Fx everything goes as planned

Totally depends on your company I think.

At mine there is a 5 day waiting period, covered by sick-time if you have it. Then you get STD for 6 weeks (well, 5 really after the waiting period) at 70%, regardless of the type of delivery.

Also, with our company, you have to use your sick time before you can get STD payments. So if you had 3 weeks of sick time accrued, you'd use that first, and then get an additional 3 weeks of STD payments (for 6 weeks total).

@regberadaisy: Yes, the NYS disability is downright pathetic. Luckily my company supplements it to 100% of pay, but I can't imagine how they expect anyone to get by on that! $120/week doesn't even buy groceries.

@Mrs. Lemon-Lime: Yup - he's probably banked that much leave (I definitely haven't lol)! Our policy only allows us to use the donated leave for up to 6 weeks after a vaginal birth or 8 weeks for c-sec and that's only after you use up all of your own leave...you can't use donated leave unless you've exhausted all of your own leave. They don't allow donated leave for paternity leave in my region.

@Mrs. Taco: I did not have a waiting period - I was told to call the day before my scheduled c/s

I got 8 weeks at 60% pay tax free (obviously come tax time you have to pay the tax but it was kind of a wash at that point) - which made it much more than I thought it would be (I got 1 check)

Plus being home after a baby I never left the house, so I wasnt spending any money - it worked out great for me!

ETA: I didn't have to use sick time either

@ValentineMommy: my husband is a Fed Gov employee too and he's planning on taking 12 weeks off- all paid. I guess that means he's banked that much time over the years. He also says people gift or sell ssick leave to each other. Does that sound right to you?

Florida, my company does not have separate maternity leave.

Six weeks for vaginal, Eight weeks for cesarean. STD runs concurrently with FML, but because it's STD the time off is paid.

ETA: one week waiting period using PTO before STD kicks in

ETA: STD pays different % depending on the week, the first five weeks are at 100%

@Mrs. Taco: everyone as far as I know. It's the same std you collect if you got hurt/sick and had to take time off work. Your employer can also purchase plans to increase that amount. My employer when I was pregnant with dd 1 did. I think the plan they purchased increased it to $250/week? Then of course you could've had something like Aflac on top of it.

And you're right; it's better than nothing!

I know they had specifically negotiated this between the disability company and my employer. (Large employer.) Our reimbursement started after 4 weeks OR after using all sick time, whichever was later. There was a cap on the weekly amount and it was nowhere near my salary. The total "disability" time was 6 weeks for a vaginal delivery, 8 weeks for a C section. So, if you had 4 weeks or less sick time available, and had an uncomplicated vaginal delivery, you'd get 2 weeks of pay. I had a C section and had some complications so I ended up with about 6 weeks "paid".

I had to wait 30 days (essentially 4 weeks) before disability kicked in, and pregnancy is considered a 'pre-determined' condition with 6 weeks recovery for normal birth, 8 weeks for c-section. So ultimately STD only covered 2 weeks. That was only at 50% of my pay. Would have been nice if they back payed!

Thank you all for your responses! It looks like the 6/8 week rule is pretty standard. Just hoping the caveat written in "If you have the 14- or 30-day waiting period and you are hospitalized, the waiting period is waived." is to be interpreted as literally as I am taking it!

@regberadaisy: Wow, the state gives everyone something or you are employee of the state? I know it's not a lot but I get zip from the state or my school district (I pay for my STD).

@meganmp: That's what I'm wondering..if I take the 2 weeks before baby is born off can I get 6 weeks worth of STD pay? Hmm.

@Mrs. J: I have a feeling that's how my district will be too. My EDD is 12/19 (so I basically just found out lol) so I'll have winter break and spring break paid/in addition to FMLA. I was just really hoping to get the full 6 weeks STD because regardless I'm taking 12+ weeks!

@Mrs. Taco: ok you know I teach too. I have a 2 week elimination period where I have to use all my sick/personal days (ten total) and then it's 4 weeks for vag and 6 for c section. I thought I could get all 12 weeks covered if my doc said so, but without an actual medical reason to be home (not bonding etc), the insurance company would not cover it. Since LO #2 is due at the beginning of August, I won't have to use any PTO days during the EP, unless any of our in service days fall during it.

I received 6 weeks of 100% pay, and had a c-section. The length was the standard contract length (ie, some plans are 8 weeks for c-sections, others are not), and the 100% pay level was due to my position with the company.

ETA: I had an elimination period of 1 week, which my company paid me for.
