<description>&#60;p&#62;maternity leave and FMLA run concurrently and FMLA ensures my job is secured.  I have a certain amount of sick days so I also use intermittent FMLA for pregnancy related &#34;sick days&#34; like doctors visits and again that ensures my job protection without getting in trouble for excess sick days since those are used for doctors visits for my kid and her sick days.

<description>&#60;p&#62;I'm a state government employee, and I don't pay into state disability since we have our own district system so my situation might be a little different. I was on non-FMLA, medical leave for the first six weeks of my maternity leave since I was physically recovering from the birth until I was released to go back to work by my OB. From 6 weeks on, I was on FMLA since that was optional bonding time that I chose to take. &#60;/p&#62;
&#60;p&#62;My entire leave was paid at 100%. The first 6 weeks exclusively through sick leave, and the remainder through a combination of sick and vacation time.

<description>&#60;p&#62;@78h2o:  We have to file for FMLA for a disability. If you have a disability and FMLA time left, it has to run concurrently per our company policy. If you don't have FMLA left, but you go out on disability, they can technically fill your position with someone else.

&#60;p&#62;ETA: Ahh, I did just find this in my employee handbook regarding vacation leave. Sounds like your friend's employer must have a similar policy. &#60;/p&#62;
&#60;p&#62;&#34;7. Serious illness of a staff member occurring during vacation is considered sick leave and is not charged to vacation unless sick leave has been exhausted. Staff members may be required to furnish a written physician's statement. If the illness constitutes a 'serious health condition' under the Family and Medical Leave Policy, an eligible staff member must comply with those specific requirements. (See Section 15).&#34;

<description>&#60;p&#62;I have read my company's policies and it really isn't clear whether I HAVE to use them concurrently. I know that people who have worked for the company for less than a year are not FMLA eligible and use vacation/sick leave. I know last time they expected me to use sick/vacation/FMLA concurrently, but I'm not sure that I'd HAVE to? I'm sure my boss would agree to hold my job for 12 weeks, but not sure if I'd also need the FMLA protection? Seems that if you had an approved 12 week vacation, they couldn't fire you over that? Hmm... I think I'm going to have find someone at HR who really knows the rules.&#60;/p&#62;
&#60;p&#62;My husband works for the fed gov and missed over 3 months of work last year for health reasons... he did not use FMLA for any of it; they held his job because he had the sick/vacation leave to cover his time away. He could have still used FMLA to cover additional unpaid time away, according to his HR person. So that is where my husband is coming from in his belief that FMLA might not need to be used concurrently.

<description>&#60;p&#62;Our policy states we must use them concurrently.  I did (do) not have enough vacation/sick time to cover the full 12 weeks, but regardless I have to use all of my available PTO in conjunction with FMLA.  FMLA is not paid, however it is the only thing securing my job when I return.  I think most companies make you do both.  &#60;/p&#62;
&#60;p&#62;A coworker ended up needing surgery at 20 weeks pregnant, she had to take 2 weeks off, she tried to use just her vacation but they made her use 2 weeks of FMLA as well as her vacation, so she only had 10 weeks for when the baby arrived.  They said because it was a medical reason FMLA came into play (and that way she didn't have technically 14 weeks off in the time frame.)

<description>&#60;p&#62;With my job I had to use fmla concurrently with my 6week paid maternity leave, after the six weeks any accrued vacation/personal time I had ran current with the rest of my fmla.  &#60;/p&#62;
&#60;p&#62;I also had the added fun of my husband working for the same company, and when that happens you share the 12weeks of fmla. So he took two weeks (which ran concurrent with two weeks of his vacation time) which left me with ten fmla weeks.

<description>&#60;p&#62;If you read the FMLA statutes (which I have in order to get what I deserved but I am not a lawyer and you should read them yourself) it is correct to use them both concurrently.  In fact it would be illegal for your job to not let you use your leave if you elect to.  FMLA just garuntee a your job is still there it has no monetary value.  Now if they let other disabled persons use leave without FMLA there are other issues.

<description>&#60;p&#62;Even though my sick/annual leave covered my entire leave time, I still filled out FMLA paperwork.  It helped because it protects my job and when they look at my leave balance it will show that I was out on documented medical leave (aka not just taking a bunch of vacations).

I also pay into a separate disability insurance account, so this time I will get that as well. I will be taking 14 weeks off, but then I get summer break on top of that, which doesn't count as part of my maternity leave.

&#60;p&#62;I have 14 weeks of accrued sick/vacation leave and am eligible for 12 weeks FMLA.&#60;/p&#62;
&#60;p&#62;Last time I took 12 weeks of maternity leave. I used 12 weeks of sick/vacation leave, so I was paid the entire time. My HR department had me submit FMLA paperwork, so I used FMLA concurrently. My husband doesn't think I should have had to use FMLA leave since I had enough paid leave to cover the time I was out. &#60;/p&#62;
&#60;p&#62;Thoughts? Experiences? I will obviously check with HR, but it would be nice to save the FMLA leave for later in the year (or use a combination of the two) in case I had a need for unpaid leave later in the year.
