@MamaG: That's true. I think it's hard for her to extend courtesy when her firm has never treated her that great :meh: I def don't understand why he was giving her more new work knowing she can't finish even if she works this whole week.

@Chuckles: I totally get it! I guess it's just tough b/c she just found out she got an offer for the new job, and in law they had to vet all her cases to make sure there are no conflict of interest, so she didn't want to randomly take days before she knew for sure. Plus I didn't think 2 days out of 2 weeks is that bad; it's just coinciding with holidays!

IMO, it's professional courtesy to give a full two weeks notice, where you will work each of those days. My employer does a payout of up to 160 hours of accrued vacation. I'd make sure that I wasn't in excess of those hours before giving my notice.

At my last job, they had it in the policy that the last day of employment had to be worked. You could take off all the days prior, but the last one you had to be there.

To be honest, unless your friend didn't expect to give notice, I would say that the days should have been taken before giving notice. I feel like it's not super great to give 2 weeks notice and then work only 7 out of 10 days left, especially if you need to wrap things up before leaving. Though I guess this only makes a difference if your friend will eventually need a reference from this employer.
As a teacher, I had a couple of teaching assistants give notice and then take a ton of time off. While I understood that the time was owed to them, it totally screwed up those two weeks to have someone off when we were already worried about transitioning when they left.

@snowjewelz: Ahhh I get that, as long as she gets the $$$ for the extra day (even if he's being a big ole jerk and making her come in instead of using it as normal vacation!)

ETA: Oh she says she knows haha. It's the whole principle of it that she is annoyed about!

@Freckles: Yes, so now she is going to go in on Thurs for a few hours just to not burn the bridge. The whole office thinks this is crazy but who is going to argue with the boss?

And yeah, if I were to leave, even if I can't finish up what I have on hand, it shouldn't be my fault as long as I hand it off responsibly?

@snowjewelz: not sure where your friend is located but there are state laws that require vacation payout for those accured:

24 states--Alaska, Arizona, California, Colorado, Illinois, Indiana, Kentucky, Louisiana, Maine, Maryland, Massachusetts, Minnesota, Nebraska, New Hampshire, New York, North Carolina, North Dakota, Ohio, Oklahoma, Pennsylvania, Rhode Island (after one year of employment), Tennessee, West Virginia, and Wyoming--and the District of Columbia require that your employer include any unused vacation pay that has accrued (that you would have been entitled to use) in your final paycheck.

I am pretty sure that vacation can be paid out when you terminate, even if you have a "use it or lose it" policy. But maybe it's different in the US.

That is not true, two weeks notice doesn't mean two weeks have to be worked!! I think all that matters is that any work is finished up or passed on before leaving. I would think that she would want to leave on good terms?

@mediagirl: Well she already conceded to take only 2 out of the 3 days, so she'd be off tomorrow and Thursday and be done. Her boss is trying to make her come in on Thurs still to file something when she can just file it today; plus giving her new work that he "expects her to finish". Who gives someone new work when they're leaving?!

I would think she would work until the final 3 days and then take those as vacation days. Is that the case here? Strange her boss is still pushing her with work in her last days...

Do you expect to be able to take them?

My friend has 3 days left to take. She gave 2 weeks notice and is already only taking the 2 days since there are holidays in between too. Her boss kept giving her new work, and told her when 2 weeks are given, 2 weeks are worked. And trying to make her go in on Thurs to do something that she can do today (file something, law related, client already approved).

Is this fair?

I have no experience b/c I only left a job once and I loved it so much I gave like a month notice and I think I got paid out for days so I didn't take anything.
