@renee0106: what!?!? There is no way I would pay for a full day of care while she is at a dr appointment and not watching my child. That is absurd! Glad you are looking for new arrangements

@renee0106: That is crazy that she wants PTO for a full day every dr's appointment! There has to be some limitations even if she does want PTO like that... I'm curious what her contract will be.

We use an in home daycare, but it was up front that she gets paid holidays (which ones) and that she gets 2 weeks paid vacation through the year, this is sick days/personal days/vacation (she closes Christmas Eve - NYD.) I would not necessarily ask not to pay but I would for sure ask for (in writing) what the terms are for sick/personal/vacation days as well as which holidays are paid. For me NYE is not a holiday, but NYD is. I would expect that NYE would be a personal day (count against the 2 weeks.)

Thanks for everyone's responses! I talked to her after work yesterday and now she informed me she was pregnant and due in July. I asked her for a contract and she told me she would work on one. But in the mean time, she is expecting to take a full day off every day she has a doctor's appointment until she has the baby and wants me to pay for every day off!

Needless to say, I'm finding a new daycare. Lesson learned, I should have got a contract in place before we even started there. We just kind of knew her through some friends so I thought she was going to be reasonable. Oh well, live and learn.

I've used 3 different in homes and their pay varies.

Currently we don't pay if LO isn't there regardless, but she does have a 15 hour minimum/week, so last week even though DS was only there 10 hours (she was closed 2 days, didn't need daycare 2 days) we paid for 15 hours.

My backup in-home asks for full-pay anytime LO is scheduled, so if I had him scheduled to be there, and he is sick, I pay anyways.
I would not pay if she was closed.

A prior in-home did have some days that were paid-days off. She asked to be paid for 4th of july, thanksgiving, christmas, etc.

So just have her get you a contract or schedule of what she expects and you'll be set for next time. ;) You can consider what you may have overpaid a Christmas gift?

We pay if DS is absent for any reason but they get Thanksgiving and the week between Xmas and New Year's off and I think every major holiday like Independence Day and Memorial Day and Labor Day, which we don't pay for. They have two adults for 6 kids plus an assistant so I haven't heard of a sick closure from them but I would imagine we wouldn't pay.

My LO started in home daycare a few months ago and all the ones we interviewed had a specified number of vacation and sick days which we pay for, as well as paying for holidays. Basically full pay every week unless they go above the allotted time off.

We had a contract with our in home daycare that specified that we paid for the full weeks even during the provider's vacation and holidays that they were off. Same is true for our center daycare currently. That said, she also had an assistant so if there was a sick day for the provider, we weren't left hanging without a provider. I definitely would get a contract in place.

We have always done in home care. Thankfully, all have had back up in place for sick days, but for 2 of the 3 providers we have had, we do pay for vacation days and dais if we decided to pick up LO early/not send her. Daycare gets 2 weeks of paid vacation a year, and in exchange, we get to keep LO out for 2 weeks without paying (when we do some sort of vacation). While not totally ideal, DH and I get pto from work and liken this to being her pto.

Ours is the same as @runnerd. If don't bring him, we pay. If she closes, we don't. She took a week vacation this fall, but gave us almost 8 months notice.

I agree with all to get a contract in place ASAP.

@erinbaderin: I actually think it's pretty typical with in-home providers to get "paid time off", at least in my area. It's one of the many reasons we didn't use an in home provider. I want to pick my vacation days.

Yes I am definitely going to ask her about getting a contract in place when I pick him up today. That was my new mom naivety not asking for one before we started there.

I did already pay her for last week while she was sick, so maybe I'll just let it go for last week and make sure it's clear going forward.

@erinbaderin: I fully understand, I am a contract employee, so I get the pros/cons argument. I do not get paid when I take a sick day or a vacation day for that matter.

Something along the lines of what @JoJoGirl just wrote seems reasonable.

@looch: It's totally different, though. If she wanted the perks of being a full time employee she should work at a daycare centre. It's the difference between working for somebody and having your own small business. You get perks (you get all the money) but there are also downsides.

You should've worked out ahead of time how many sick days she is allotted (you are her employer, basically). If you didn't, I would set expectations now going forward. Our in-home had something like 5 days/year of unscheduled closures, including sick days (but not snow), and anything beyond that they didn't charge us for.

I personally have no experience with in home daycare, but I know that a friend had her provider hit her with a "revised contract" at the beginning of last year where she wanted to be allowed 2 weeks paid vacation and 5 days paid sick time. My friend pushed back on that. It seems to me to be totally reasonable that you have to pay for days when it is your decision to not send your child (if you go on vacation, if your kid is sick) and I guess maybe holidays, but if your provider is sick or goes on vacation that seems like you shouldn't have to pay. I agree with everybody else who has suggested you get a contract with all these things laid out.

I don't see it so black and white. When I was a full time employee, when I was sick, I still got paid, so I kind of feel the same should be applied to an in home day care provider.

eta: at least for a pre-determined number of days per year, not unlimited.

Definitely ask for a contract - I had one when my LO was the only child out in home provider had. Ours specified that if she cancelled we didn't pay, but if we chose not to bring him for a day we still pay.

We only pay our in-home daycare for the days that LO is present. So if there is a holiday, LO is sick, or our daycare lady is sick or on vacation we don't pay. But, she has a pretty informal setup as far as that goes, so... I would definitely ask your provider what she expects so that you're both on the same page in the future.

While we don't use an in-home, so I don't have any experience, it doesn't sound fair that you have to pay when she is sick... that doesn't seem right.

I assume you've already paid for the previous week when she was sick, so I wouldn't try to deduct it now, but I would definitely get a contract in place for the future.

LO has been in and in-home daycare for 5 weeks now. She only watches a few kids (including 2 that are related to her) and she never had anything for us to sign when we started with her.

Last week she was sick for 2 days and the other 2 days she was closed for New Years Eve and Day. So we had to make other arrangements for LO for 4 days of the week. We still paid her a full week of daycare even though she watched him for 1 day.

My question is, should I ask to not pay her for 2 days this week? We never really talked about how it would work when she was sick and I had to find other daycare to cover for her. I know it's pretty typical to pay daycare for the holidays when they are closed, but I don't know what's typical for when the daycare provider is sick?
