@Corduroy: just to chime in and say in general the image you get from a company when you interview with them is usually very different from when you actually work there. Atleast that has been my experience. I would look online on places like glassdoor to see if there are any employee reviews

I had my interview so I figured I would update. HR raised the issue during the onsite interview which relieved me of trying to figure out how to bring it up. After confirming that I had seen the complaint - and not addressing it - they explained the whole HR team at this site was cut and replaced. There is a new system of training and oversight. Training is extending one level further down in the structure.

I tried to get a sense of what actual changes are taking place from other people I interviewed with. People kept referencing changes and training - lots of training. I think I got what I needed to hear.

@Corduroy: wow, yes, that sounds like a very different story... in that case it's worth watching the interviewer's reaction when you ask. Are they going to get defensive, or have some info on what they're doing to address the problem? If they're doing anything....

@Mama Bird: I’ve considered that the lawsuit might not hold water. This is a manufacturing company with video recordings and tons of records required by law and industry standards. The complaints mostly refernce incidents that would be documented on video or with electronic records. Knowing that there’s video and records of most of the complaints makes me think that the plaintiffs would be less likely to complain without cause.

Based on my experience in my area of manufacuting the production floor is lightyears behind the office world in treating people equally. What I read was pretty shocking to the part of me that has been in an office for the last few years but part of me but seens legit when I think of itin context of a production environment. At least in my experience management has tried to address the issues but in this case it seems like they were swept under the rug. It seems like the contested part will be who management is and if they had knowledge and did enough to address the situation.

Do you have reason to think the lawsuit holds water? Maybe Glassdoor reviews, news coverage, etc. Asking because it sounds like there's no verdict yet, and of course there's a much lower bar for filing a lawsuit than for winning one.

Case in point, a couple of DH's coworkers have a racial discrimination suit going right now against their boss, with the claim that they were systematically denied promotion due to race. Clearly some lawyer thought their case is worth taking on, but the info I have from DH is that top management is actually very diverse, and one of the plaintiffs (who he works with directly) is one of the more ineffective and checked-out staff in the department...

@Corduroy: Like you, I’d want to know what they do to promote equality and protect against discrimination. Maybe ask that first? Then if their response is unsatisfactory, I’d mention that you know about the lawsuit and need to know that they are serious about racial equality; hearing details of their equality plan is necessary for you to feel comfortable accepting a position there.

I’m not sure at what point to ask. I’d say just use your best judgement.

@Madison43: Agreed 100%. They will give you a very buttoned up we can't comment on that given it's in active litigation. Your best best is to continue searching online for reviews at glassdoor, news articles, whatever. I turned down an offer once I got deep down the rabbit hole and found they fired their general counsel the day after she got them out of multiple wild lawsuits. I found the article in an issue of Latina Today talking about how to bounce back after a job loss. So random, but I was really trying to find out more. It showed the company's character and she mentioned in the article what it was like working for the company (not good). But, it was an online magazine publication that gave me the scoop that I needed! And, it wasn't a major company. A mid-size non-profit. Although, the offer I did accept has turned out to be just as bad, but I digress. Good luck!

@Madison43: I expect they won’t be able to comment on the lawsuit specifically. But without any additional information I don’t think I would take the job. I guess I’m hoping they could give a picture of how they promote equality now.

@Pollywog: I’m just starting the interview process and I have the phone screen with the hiring manager tomorrow. I don’t have a good sense of who I will talk to from there.

If the lawsuit was filed this year, it’s likely still going on, so I’d expect that they won’t be willing, or able, to say much about it.

What's the interview process like? Who are you interviewing with? I'd definitely bring it up, but probably in person. Ideally with someone high up. Not HR.

I’m interviewing for a techinal position with a company in my small field. The job is up my alley and the commute, while not ideal, would be possible. In my research I discovered a lawsuit filed against the company this year accusing them of systematic racist practices. I read the full complaint online. Obviously this is concerning. I wouldn’t consider taking the job unless the company could give a seriously good explanation of how things are being improved. Even then - idk.

At what point in the process do I ask about it? What do I ask? Who do I ask? All I can formulate in my head now is “I saw that complaint - wow.”
