<description>&#60;p&#62;I checked back over our consent forms, and there was no divorce mentioned in there for some reason.  There is death mentioned and we decided that we would let the surviving spouse decide what to do.  We also checked off that we would want to donate any embryos that we didn't use to another couple needing embryo adoption.

<description>&#60;p&#62;Donating to science is DEFINITELY different than donating to another couple. Based on the choices your clinic gave you, I'm guessing that your clinic doesn't have a donation program. &#60;/p&#62;
&#60;p&#62;BUT, even if your clinic doesn't have a program for donating embryos, you can still choose another program around the country to donate your embryos to and they would allow you to be part of the process of who receives your embryos. As someone who will likely use embryo donation/adoption in the future as a way to grow our family, I hope more people will consider that option instead of discarding them. :-)

I did think of the questions you have and I would assume this is something that should be discussed in the divorce papers, if it came to that. Like @mrswin:  said, these documents wouldn't hold up in court and these docs are used to cover the clinics butt and have some sort of direction if these situations happen.

Or does the child &#34;belong&#34; to one parent the same way the embryo did? Just curious if the forms cover these kinds of issues.

<description>&#60;p&#62;I just read over our consent.  It only gives us the death option but we had to sign that we would notify the clinic if our marital status changes.  In the case of death we put that we would let the other person make the decision.

I don't know if I would actually use them but I felt that I would want the opportunity to make that decision at that point. Donating to research was an option on our form with a totally separate option to donate them to another couple. &#60;/p&#62;

<description>&#60;p&#62;We didn't have the option of donating to research on our forms, otherwise we would have chosen that. We chose to have them discarded in case of divorce. In case of death of one partner, we chose to have embryos go to the sole possession of the other person. As it is, we have one remaining embryo frozen and have decided not to continue paying for its storage, so this will a be moot point soon.
