<description>&#60;p&#62;Yes, I think the judge correctly applied the law to the racial discrimination case.  She has no standing to bring the racial discrimination case.  If she reported it and was retaliated against as a result of that action, she could bring a retaliation case, and as @MsLipGloss: said, her sexual harassment claim remains before the court.

<description>&#60;p&#62;@Mrsbells:  well, that doesn't help if the plaintiff is a liar. Hostile work environments doesn't necessarily mean there was discrimination.  Her case being thrown out doesn't negate what Paula Deen admitted to saying or her sorry apology tour.

<description>&#60;p&#62;Anyone can take offense, but to alledge discrimination I think the bar must be set higher. If the plaintiff could prove that she was retaliated or discriminated based on her association with the protected class then I would imagine there would be some teeth in her case. For example all the freedom riders who were harassed along with black people during the voter registration drives in the '60s.

From a legal stand point it makes sense that you must be the person affected to bring a claim. However if I witness some form of discrimination against a different race from me and I report it, I would be dissappointed to hear to get this answer.
