I'm NOT a lawyer but I would think maybe there's something up there. Maybe start another thread about it? I would think if that buyer backs out then the owner would want to go to the 2nd highest buyer- I don't see why you would have to pay off the buyer. And the fact that your agent seems to be in on this, to me says TIME TO GET A NEW AGENT. I get that $5k might be worth it to get into that neighborhood but I'd be worried about anything else sketchy that might have gone on or might go on during the process. I don't know if $5k would be worth the worry for me. Good luck!! I TOTALLY understand. we were going through that at the beginning of this year and it is so so sooo tough out there. Things are going in HOURS. And from experience, coming in second is absolutely the worst. You would almost rather be way out of the running. </p> <p>Our worst was coming in second after a bidding war and lost because the other people waived their appraisal and home inspection. On a 70 year old house! People are doing crazy crazy things. </p> <p>We got ours only because the seller of that one we lost on gave a heads up to the seller of our now home and we got in with a contract before it really went on the market--much to the chagrin of about 50+ other potential buyers who didn't even get to see it.
