&#60;p&#62;@honeybear:  now knowing a tiny bit about the subject, I agree with you but it would have been helpful to be warned. I just think he should have asked some questions since after the fact he stated that they don't typically snake galvanized lines for this very reason. Had he know they were galvanized he would have suggested replacing the line as opposed to snaking it (which is what we ended up doing anyways and would have avoided the water damage if we would have done it from the get go!) &#60;/p&#62;
&#60;p&#62;They ended up cutting a huge deal for us doing the correct plumbing work. They were able to work something out with the water restoration company as well. So all we'll be responsible for is the drywall repair. We are so thankful for how it ended up. Sometimes being a homeowner isn't all it's cracked up to be!!

<description>&#60;p&#62;I don't know anything about Oregon law, but I'm guessing that unless he was negligent in how he attempted to unclog the drain, he's not responsible for the damage. And that seems to me to be the right result: old stuff wears down and breaks eventually, you know? &#60;/p&#62;
&#60;p&#62;It would have been nice if he'd warned you that old pipes might break more easily during snaking, but I'm not sure how he could know their age and condition without doing a full inspection that would probably have to involve ripping apart your walls. On the other hand, maybe you would have a better sense of their age since you probably know the age of the house better than he does. &#60;/p&#62;
&#60;p&#62;It's a lousy situation and I'm sorry you're in it, but setting aside negligence, I think he's probably right.

Unfortunately, we have two filed claims from our old house and if we file another claim we'll likely get dropped from our insurance. If that happens, it's really difficult and expensive to obtain new insurance. I'm going to try to work out some sort of a deal with the plumber like they pay for the water remediation and we'll pay for the drywall repair. I just can't believe they won't help us at all.

It might be less than your deductible but you could also check your homeowners insurance, I think they'd be able to work out liability similar to car insurance, so you wouldn't have to deal with it.

<description>&#60;p&#62;We recently bought a house (in Oregon) and the kitchen sink was clogged a few days later. We had a plumber come out to fix it, while he was snaking the drain, he broke through a cast iron pipe and water leaked into our finished basement. It was enough of a leak to require part of the ceiling and the walls to be ripped out. He claims because the pipe was old, he is not responsible for any damage. We think, because there was no contract signed, no warning of risks of breakage, no questions as to what kind of pipes we have, he should be responsible for some of the damage. We're not asking him to foot the whole bill but some help would be appreciated. Any ideas?
