@MsLipGloss: I see the two as different. When you are dead your family cannot talk to you, send you letters, look at you, or visit you. AH would still be able to watch his child grow up.

@Mrs. Lemon-Lime: Understanding that the past cannot be changed, going forward, we should (from a legal perspective) strive to prevent any further unnecessary consequences . . . and in this case, Massachusetts does not have the death penalty, so AH would be paying the ultimate price according to state law.

ETA: In my opinion (although I am sure it is not shared by all), a loss of freedom is akin to a loss of life. :(

@MsLipGloss: Losing your freedom is not the paying the ultimate price; losing your life is and the victim paid it.

I don't know enough about how the victim died to pass judgment. All that I can tell is Hernandez was there, held a gun, and destroyed evidence.

@MrsSCB: bad news. Ugh.

I was listening to Mike and Mike this morning and they had someone from the prison where he is going to be held until trial talking about what his experience will be like while he's there. They go through this whole process where they ask if an inmate is involved in a gang and even if they say no, they check their tattoos to see if they have any gang related ink. If they do, they put them in certain "wards" where they won't be near rival gangs. It's amazing what they have to go through to book someone into jail!!

@MrsSCB: What I am getting at is that your original statement "It sounds like they must have a pretty good case against them if they're denying him bail" is inaccurate . . . the judge does not consider the strength or likelihood of success of the prosecution in determining whether or not someone should be released on bail. Bail can be denied or granted for a multitude of reasons that have nothing to do with what the prosecution is, initially, setting forth as its basis of proof, as such *proof* or *evidence* has not yet been subjected to the tests necessary to determine whether such proof would be admissible at trial/ presented to a jury. As an attorney, I can say that there are many reasons why evidence/testimony is never presented at trial, and would not be proper for presentation to a jury. A denial of bail is not cause to make assumptions regarding the *strength* of a case. This is, unfortunately, a common misconception.

@MsLipGloss: So you don't think that anything related to the crime he allegedly committed (whether or not it's called evidence at this point) would go into determining if he should be let out into society or not? That just seems unlikely to me.

@MrsSCB: At this point, there has certainly been no trial, nor has AH even had a chance to defend himself. Until then, nothing is considered evidence (it all has to go through a vetting process). His resources and prior behavior are certainly considerations for bail, I don't dispute that, but the (relative) strength or weakness of the prosecution's case has yet to even begun to be determined.

ETA: Nothing is considered evidence such that it would be presented to a jury for the purposes of determining innocence or guilt.

@mediagirl: Yeah, I know that's the way it is. But that doesn't make it okay. While we can control what we do, what we can't control is what we are accused of doing. And as we as adults know, accusations can have no basis in logic or fact, and yet, they remain intact until someone has gone through the lengthy process of proving their innocence (as opposed to being innocent until proven guilty). No matter what the outcome of this case is, AH's life has forever been changed, and not for the better. The stigma will last forever . . . and will even haunt his child.

I don't know much about him or the case... but I think that with enough money and a good enough lawyer, you can get away with just about anything. It makes me feel ridiculously cynical to say that, but I happen to think that it's unfortunate but true.

@MsLipGloss: unfortunately that is how society is today, though. The media is all over EVERYTHING. If you don't want to be in the headlines, don't be famous and get in trouble or be in a situation that may make you look bad.

That's my motto and something I will be passing on to our daughter - don't put yourself into a situation where you could either get in trouble or be accused of doing something just by being there.

@MsLipGloss: I don't know if that's true all the time. Part of denying bail is related to whether a person is a flight risk, which I said I imagine Hernandez is given the resources at his disposal. But part of it is whether he could be a danger to the community. I could easily see evidence having an impact on that one.

@MrsSCB: Whether or not bail is denied has nothing to do with how "good" a case appears to be.

@mrbee: I agree. I loathe trial by media! Innocent or guilty, there is a process of adjudication that MUST be honored and respected because the accused stands to pay the ultimate price . . . losing his freedom.

@bpcmarj: Regarding the additional media coverage . . . exactly. It really skews the story for the rest of the country.

Gotta say, destroying surveillance footage and handing his phone over in pieces is a sure sign of extreme shadiness IMO. Even if he didn't do it, he obviously knows what happened. So awful all round, to have eveything and just throw it away so stupidly.

It sounds like they must have a pretty good case against them if they're denying him bail, although I suppose they must think he's a flight risk since he has a ton of money and could hire private jets, etc. It's not looking too good for him, though. Video evidence of him with a gun is pretty incriminating and destroying surveillance video is not exactly the act of a person with nothing to hide. It'll be interesting to see if this turns out to be another OJ situation, though.

ETA: I also don't think the Pats would have dropped him unless they were fairly convinced. He's just too good otherwise.

@mediagirl: I'm with you in that he won the life lottery. More money than you'd ever need, playing for one of the best teams/coaches in the NFL (with the best fans if I do say so! ;) ) and then, even if he DIDN'T murder the man, there was enough evidence surroundimg a murder to get you charged with it. It's so sad. Why be such a thug? I just don't get it.

Also, it's been nonstop in the news up here (since he is a Pats player and the murder happened nearby) but some people are pissed because there have been several homicides recently, including a double homicide in my hometown, and there is only so much media coverage because of who he is/was.

The guy won the lottery of life. He is only 23 or 24 and had a huge NFL contract with the Patriots. A guaranteed 16 million coming to him in a 40 million dollar contract plus his signing bonus. He has an amazing home, a wife and a baby born in November.

Yet somehow, he couldn't stay away from trouble and he goes from this plush life to a jail cell as he's been charged in the murder of Odin Lloyd.

Here's a good article on the timeline if you're interested in reading about it:
http://bleacherreport.com/articles/1685469-complete-timeline-of-the-rise-fall-of-aaron-hernandez

Did he just think he would get away with it because he plays (eh hem, PLAYED) in the NFL?
