@Ms.Mermaid: Sending hugs and hope everything works out. I would make sure you get EVERYTHING in writing since you know how they operate. Good luck!

@Ms.Mermaid: I would've probably done the same. It's funny because everyone always tells you we have rights. Sure. By law we do. But it's a heck of a hard thing to prove and is it really worth your time and energy. At the end of it you'll probably be out of a job too.

I did finally get the formal offer and accepted it. It's not really that I'm pleased about taking it, but my job was offered to another candidate who had accepted it already, and financially it isn't feasible for me to be unemployed from August-January when I'm ready to find a job, and it's unlikely that I would be offered a different job considering how pregnant I am and how long I would work before going on leave.

I've started to put feelers out in the community already for who might be creating new positions or in a position to hire come January, because I figure at least this way I don't have to feel guilty if I end up leaving when they won't give me more leave if I need it.

@Little Misters Mom The irony is that I'm a lawyer. From everything I can tell, it would be pretty hard and not worth it to sue in this case, especially because this office has a strong track record for being a disorganized mess. I decided that the best course of action would be to take the job, because it probably won't hurt to at least see how it goes.

As a lawyer, my advice is always to consult an employment lawyer in your state. But based on what you've said, it sounds like it would be very very difficult to prove pregnancy discrimination (which is difficult to establish under the best of circumstances). You may just need to decide whether you are willing to work for the salary and leave currently on the table. And whether you want to work for a company that engages in this kind of behavior. If you do, I'd email the HR, cc both the head of HR and your highest contacts in the company saying "per our conversation on x date I understand d the current offer to be x, y, and z and I'm pleased to accept." Then In the politest terms you can muster say you expect to see their letter within 24 hours. Then just keep calling and nicely but firmly demanding their letter. So sorry you're in this situation. Also, save all emails and messages and make notes of all conversations, just I case you do decide to pursue legal action.

Such a sticky situation!

Do you even WANT to work for this company anymore? I mean if this is the way they are going to treat you I think I would look elsewhere!

Is your old job gone?

Sorry - no real advice but sympathy. That sucks.

I know you said you told your current boss already...You said she extended an offer to a candidate for your current role - did that person actually accept? I think deciding to stay is totally reasonable. I wouldn't want to work for this new company. They don't seem trust worthy

Wow! They are changing a lot of the conditions under which you originally accepted the position! How would you feel about contacting the head of the HR dept.? Can you say to them that you feel they are reneging due to your pregnancy ( allude to PG discrimination without threatening them) ? Maybe that will get them to reconsider the changes in your offer..

I recently accepted a new job, and worked out that I could still take 12 weeks of unpaid maternity leave, and the company would pay their share of my health insurance premium. Because I wanted to start there as quickly as possible and also go on their health insurance as quickly as possible (I'm due at the end of October so I didn't really want to change health insurance in October), I gave them a start date at the end of July, was given a range for salary and an offer contingent on my background check clearing, and was told an offer letter would be forthcoming. A week before I was supposed to start, they reneged on salary and told me that salaries were frozen and non negotiable and lower than the rate that the person in HR had quoted me. I immediately expressed concerns to the department head that this made me afraid they would reneg on my maternity leave. He assured me this would not be a problem, and then yesterday they reneged on maternity leave and now I can take 6-8 weeks or whatever is medically necessary. I had let my boss know that she could go ahead and extend an offer for my job to one of the candidates they interviewed (I did this for personal/organizational reasons that have to do with me liking the people I work for and thinking they should be able to move forward on the hiring process.) So at this point I have no leg left to stand on and was told that I was never technically promised 12 weeks (even though I was, just not by the HR director and not technically in writing, although it is very clear from my emails that I had been told this over and over and over again.)

I keep mulling this over in my head and genuinely believe that this is an attempt on their part to keep me from taking the job. I start in less than two weeks and even though I was told yesterday that since I was still willing to take the job (which the director of HR seemed to find disappointing), I would have a formal offer letter right away. However, still no formal offer.

Has anyone experienced pregnancy discrimination in hiring? Does anyone know how hard it is to prove?
