<description>&#60;p&#62;@Mrs. Goose:  I like the idea of a garden fence! I was going to suggest lining things up against the property line like potted plants, chairs, and gardens to at least curb the driving through your yard.&#60;br /&#62;
My husband's cousin deals with crap like this!&#60;br /&#62;
As for the dog, speak to them about the issue and liabilities. Then when you see the dog in your yard, put him on a leash and walk him back.  If they still do nothing about it, suggest you will call animal control the next time their dog is in your yard. Be tough if you have to! If you don't complain, a lot of people just assume it's ok!

<description>&#60;p&#62;I work in insurance &#38;amp; yes... you and your insurance company can be sued if something were to happen. A health insurance company can subrogate back to your homeowner's policy for damages. &#60;/p&#62;
&#60;p&#62;If shrubs or a fence isn't an option, I would have a frank conversation with the neighbor and document it... time, place, what was discussed, etc. If that falls flat get them to sign a waiver of subrogation  :silly:

&#60;p&#62;It’s sad but true. Even if you don’t want to, your insurance can sue on your behalf. My friend served on jury in an insurance case like this. Two adults, friends, and one friend had tripped over a branch at his friends house and broke his leg. The insurance sued the friends insurance for neglect or something like that. It was a weird case and the two friends told the judge in court that they didn’t want to persue it but insurance made them. I think judge ended up dismissing it

If that didn’t work I would do the decorative fence or shrubs. I don’t think that’s passive aggressive, I think that’s life. Fences make great neighbors. Since a true fence isn’t an option I think some of these other alternatives are great ideas. We planted privacy trees for no reason other the we like privacy when were out back. We don’t hate our neighbors so I think that’s a totally valid solution

If the child gets hurt because of something wrong my yard then they could argue that I was not a responsible home owner because I have a kid the same age and she could have been hurt in the same manner. Likely, my insurance company would settle and not go to court, but my insurance rates would go up either way.

<description>&#60;p&#62;The free range dog would bother me more than the tire marks. Mostly because I would be livid if I (or my kids) stepped in dog poop in my yard when I don't have a dog. Plus I don't think its reasonable to allow dogs to roam neighborhoods freely, for their safety. &#60;/p&#62;
&#60;p&#62;For me I would think long and hard about if I really wanted to have the conversation - if the pros (no dog poop, safety of child) outweigh the cons (maybe souring the relationship). I'm not sure.

<description>&#60;p&#62;I think planting shrubs or putting up a decorative fence is really passive aggressive and likely to damage the relationship with the neighbors.  As uncomfortable as it is, I would have a conversation with them.  I don't think it's unreasonable to ask them to keep the dog on a leash so that it doesn't poop in your yard, even though they are cleaning it up.  As for the kiddo in the yard, I don't really see an issue with it.  I don't see how you would be responsible for injury on your property if the person was essentially trespassing (you didn't invite him on to your property). I prefer a neighborhood where the kids are free to run and play with one another and cut across yards to find their friends as long as they're not damaging anything.  I realize I'm in the minority here.

<description>&#60;p&#62;I'd be so excited if we had little kids living next door. Our neighbors do have 8(!) kids but the youngest is 10 (and our oldest is 4). The previous owners of our house had kids similar in age to some of the kids next door and apparently they'd all just barge into each other's houses and steal snacks. As for now, my kids are welcome to romp around the neighbor's yard (and across their yard into the others too), and the teens next door come over sometimes to swing on the rope swing in our yard. It's super common around here and part of the reason I love our town so much. In terms of the pool, the rules depend on the state and town--several of our neighbors have pools and the pool needs to be fenced in, not the whole yard. Our front yard is an unfortunately common poop spot (it's just where we are on the road) but everyone cleans up. My kids get to see the dogs (and meet a lot of them), and we don't have to deal with poo.

<description>&#60;p&#62;Maybe bc I’m dealing with this too but I don’t think there’s anything  neighborly withyour neighbor and  their kids and dog enjoying your yard. It’s your property and your yard and it would bother me to have kids playing in it. Like others stated, just try talking nicely about respecting your property and the boundaries. The poop thing is also a surprisingly a sore subject to many dog owners bc in the past, my parents has their neighbor dog poop in their yard, I’ve lived in a townhome where the neighbors dog would come into our yard and poop and leave. Each time I’ve asked nicely for them to come clean it up and to make sure their dog doesn’t poop in our area but the dog owners were surprisingly hostile about it.

<description>&#60;p&#62;If they’re otherwise nice good neighbours, it’s just leaving tracks but not damaging your yard, and they’re cleaning up the poo I might just chalk it up to neighbourly relations and let it go. The first time I found poop in my grass I’d be speaking to them, though - “I like my kid to be able to run around without worrying about what he’ll step in and I know you try your best to clean up but I’ve found poo on several occasions (I’d exaggerate) so if you could keep him on a stake and leash when you aren’t out with him I’d really appreciate it, thanks!”
