You have to sign something to say you want the protection and the account was open before that law came into place and he def never signed anything and they can't automatically enroll.&#60;br /&#62;
He's going to call tomorrow and straighten it out but just wanted to see what they can and can't legally do.

I have no idea - but I accidentally tried to transfer our down payment from online savings to an online CD at a different back twice and it went through and charged me instead of being declined :( Fortunately customer service was awesome about fixing it &#38;amp; refunding the fees since we'd never had an overdraft problem before - so try calling and asking if there is anything they can do! (Yay USBank for us!)

<description>&#60;p&#62;Isn't it illegal now for banks to charge you for overdraft fees if you didn't sign up for overdraft protection?  My husband somehow has racked up over $100 in fees for being short $2 in his account.  The $2 he was short was just an automatic transfer he set up from one of his accounts to another and  he forgot to stop the automatic transfer.  But shouldn't the transfer just have been declined instead of overdraft fees?
