<description>&#60;p&#62;i wouldn't assume that i got july 3rd off instead, but i would *maybe* assume that i got EXTRA holiday pay for the 4th since it was listed as a paid holiday? so i think half pay is a good sign of goodwill/misunderstanding with the clarification that unless the holiday falls on a day she is scheduled to work, then she does not have it off/paid.

@sarah.clarisse:  thanks. I totally agree that she should have asked/clarified. I care more about finding alternate childcare than the cost. My DH doesn't like paying on principle&#60;br /&#62;
@Mrs. Lion:  yes - agreed that we want to keep her happy first and foremost bc she cares for our DS daily. Having an &#34;employee&#34; is just so weird. We are the same age and she is getting her masters right now... Just a weird dynamic that we pay her to care for our son&#60;/p&#62;

<description>&#60;p&#62;I would give her the day off paid because it was a misunderstanding and I would want to be generous and understanding. I would make sure going forward that all dates are clearly laid out in advance so there is no confusion.&#60;/p&#62;
&#60;p&#62;ETA this is assuming it was a genuine misunderstanding and not an intentional manipulation. I can see how she would have looked at the contract and seen that she was getting a paid day off for the 4th of july and assumed it would be the working day closest to the holiday. I try to exercise grace whenever possible, especially to the good intentioned people who care for my child.

<description>&#60;p&#62;I might pay time and a half for the fourth as holiday pay (if for whatever reason she were working ON the fourth), but I don't think you should have to pay her on the third if she's not working.&#60;/p&#62;
&#60;p&#62;ETA: I do agree with @swedishfish:  that the confusion came from the fourth being listed as a paid holiday. Were you still planning on paying her for the fourth even though she doesn't normally work on Fridays?

<description>&#60;p&#62;When I came back from maternity leave I dropped to 32 hours a week and only work Tuesday - Friday. Which means when holidays fall on Monday (ex: Memorial Day last month) I don't get any paid holiday time.  It sucks - but honestly I can't imagine asking my company to pay for a different day off just because. At the very least she should have asked!

Knowing the nature of your job, clinics still provide care every day except the actual holiday and weekends (depending on the clinic). I work in a clinic too and we never get the days before and after a holiday off- I worked Christmas Eve and New Year's Eve last year. &#60;/p&#62;
&#60;p&#62;But I also think it was a miscommunication and not necessarily either ones fault... So I would offer half pay for that day and let her know you have to find backup care to pay for so that's the best you can do.

I think if I were in your shoes (assuming I otherwise like her) I would give her the day paid but specify that in the future you would prefer if she would check in first with this type of situation.&#60;/p&#62;
&#60;p&#62;I am guessing here that this is the first time the paid holiday on an off day has come up.  I can see where she was confused since I can see her thinking that you would have seen that the 4th falls on an off day for her for the next few years.  (I also completely understand it never occurring to you to look!)  I do stand by my original statement though that she should have simply clarified in the beginning, that part is 100% on her.

<description>&#60;p&#62;Friday is not a weekend. The reason some holidays are observed on Monday or Friday if they fall on Saturday or Sunday is because all the other days are week days not weekends. &#60;/p&#62;
&#60;p&#62;I don't understand why she would think she would be entitled to Thursday off. 4th of July is one of those holidays that is only celebrated on the day. If the holiday fell on Saturday or Sunday then yes a Friday or Monday off may occur. But a Friday 4th of July means you have Friday off not Thursday.&#60;/p&#62;
&#60;p&#62;Does she get any PTO to use for sick days or vacations? That is what I would count toward Thursday. Otherwise she's taking unpaid leave.&#60;/p&#62;
&#60;p&#62;As far as 4th of July this year, I have no idea if you should pay her. She isn't even scheduled to work on Fridays.

We used the nanny contract that the Bees posted and in it we specified which holidays are paid and unpaid. We listed 4th of July as paid. Our nanny works part time to mimic my work schedule and comes on Mon, Tues and Thursdays. 4th of July falls on a Friday this year. I do have patients scheduled on 7/3. &#60;/p&#62;
&#60;p&#62;What do you think should be done about the 7/4 holiday?&#60;/p&#62;
&#60;p&#62;(Our nanny just counted on the holiday being pushed forward to 7/3 and booked out of town travel. She said that when federal holidays fall on the weekend, you get either the Friday/Monday off instead.  So she applied that rule to this situation.  That is true if you are a FT worker... Not sure about in this setting though. Since she has traveled booked, obviously, she should go on her trip. But, should we pay her for 7/3 as if she were working and count it as the holiday? We had just thought luck of the draw with holidays and when they fall on Mon/tues/thurs. That is how it is working for me at my job at least...We will have to pay another babysitter for 7/3)&#60;/p&#62;
&#60;p&#62;Lesson learned to specify this holidays-on-weekend situation in any future nanny contracts.
