I would go straight to filing a claim. I believe he has 4 days to respond/pay and the claim stays open during that time, so it's best to do it ASAP. Have you thought about selling the iPad on Craigslist if the Ebay thing doesn't work out? I recently sold my iPhone 5 on there and it did take a few weeks and multiple listings for it to sell, but there was no shipping involved and the guy paid me in all cash.

@locavore_mama: I think the rules changed a little while back!

So annoyed. Needing a new dishwasher now, and this 300 would pretty much cover the whole cost! Grrr. I don't mind re-listing, I just need to know!

It is really annoying! New ipad comes out November 21st so I am trying to get rid of this one now. Not that I am getting a new one, but I am worried the price will go down to nothing.

I would understand if the item was inexpensive, not paying. You may bid on an item and forget you ever even placed the bid. But this auction was going wacky toward the end and I have a hard time imagining that someone would forget bidding 300 dollars on something!

Ugh, that is so annoying! I've only bought one thing on eBay, and I paid literally the minute that the bidding ended and I saw I won. I mean, why not do that? It's easier for everyone! I hope they pay up today so you don't have to worry about the claim stuff.

I would contact them first. Before you file a claim eBays ask you if you have tried contacting them to resolve the issue first.
I might be wrong but there is a longer period than 48 hrs you have to wait before filing a claim on a unpaid sale.

I sold something a month or two back and had a similar situation.

http://pages.ebay.com/help/sell/unpaid-items.html
Oops never mind it is 48 hours min.

@Mrs. Sketchbook: I would open up a claim tmrw. So annoying when they bid, win, and don't pay. I've had a string of these types of buyers. What I don't get is that they usually win right before the auction is over so they're obviously by a computer - why not just pay?! (And my sales typically aren't very expensive). Grr

This is so annoying. The bid behind this one was 300 (I actually sold it for 305) and so if he would just tell me he didn't want it, I could just offer it to the last person. I'm trying to sell this before the new ones are available on the 21st, not that it matters that much.

Sold an ipad 2 for 300 on ebay yesterday around this time and still no payment. I have communicated with him and he said he would pay last night, and I said I would ship it before noon today. So no payment, of course I am not shipping. Would you send a followup message re: his promise to pay last night and my promise to ship today? Or wait until tomorrow when I can submit a claim?
