The secretary who gave it to the other partner made the initial mistake. I don't think the accountant should be billing you.

@Mrs. Coral: That's what I'm trying to find out, but he's billing us before letting us know the outcome. I don't think he made the mistake, I think the state did.

PS the IRS and states make mistakes all the time and letters have to be written to correct them. Unfortunately that cost falls to the taxpayer unless you write your own letter.

I think you need to learn more about the notice from the state. Did the state screw up and your accountant just had to correct them? Then you definitely owe the accountant since you hired them to represent you. If your accountant made an error and the state caught it, I would ask the accountant to give you a break.

Does that make sense? I'm a CPA and when I was practicing if we made a mistake we corrected it for less than we normally would.

I'm guessing the state owes the refund, but you're on the hook for the cost of "defending yourself" (e.g. the $100 your accountant charged you) unless your accountant made a mistake.

My Husband and I have had our taxes done by the same accountant since before we were married, she knows our stuff ;)
Well last year the secretary made a mistake and gave our stuff to the other partner and we didn't find out until after they were filed. Everything was fine we thought, but then in June we got a bill for $1200 to the state. I called our tax lady who was on vacation, turns out the state is trying to tax something that isn't taxable and never has been. The partner contacted the state on our behalf. Who pays for this? Us? I feel like the state owes us the refund they snagged plus the $100 the guy billed is for writing a letter to the state.
