@BadgerMom: we did have an inspection. He mentioned we should regrout the tile on the sooner side but didn't say we would have to tear the whole thing out. So not sure how that would play out. He never noticed or mentioned the patch job on the ceiling underneath though- which we only noticed when it started leaking.

Did you get a home inspection? You might be able to go back to the home inspector and get some kind of settlement from their Errors & Omissions insurance.

@catlady: very similar! And yeah we are also a little upset that the inspector didn't notice. It took a couple of showers before we noticed the problem but then we saw the patched ceiling.

It's more the cover up that pisses us off the most. But yeah. Very unlikely we would get anything. @gotkimchi: yeah we will just fix it soon. Definitely don't want to wait extra months without a master shower.

@Foodnerd81: This sounds similar to something we went through. First morning in our new house, I took a shower, DH took a shower, and then when we went downstairs, we noticed a huge wet spot on the ceiling below the bathroom. Got a plumber in and he immediately noticed that the shower faucet upstairs had a layer of what he called temporary caulking to seal it. Some water was already leaking through, and as soon as he cut through it, a ton more water came out. The plumber said the seller definitely knew it was a problem, which is how it got sealed over, but they didn't fix it, they just hid it. He was actually pretty aghast that the inspector didn't notice it and told us to try to sue either the seller or inspector.

In the end, we went back and forth for awhile with our RE agent and the seller's agent. The seller claimed she only used the 2nd floor rooms and bathroom and not the 3rd floor one due to her health and inability to get up too many stairs, and we couldn't really prove otherwise, especially since the wet spot on the ceiling didn't appear until we moved in. We also remembered that the inspector tested that shower and it had seemed fine with no leaks around the faucet. Our agent finally advised us to let it go so we did. It sucked but we didn't think it was worth the hassle to sue.

The other thing that swayed us was that the seller left us a note with her handyman's contact info, saying he'd done a ton of work for her over the years. It was obvious this guy was a total hack but I think she genuinely thought he was good, so maybe she really did think he fixed the issue.

Ugh we have a similar problem. The previous owner obviously spent a ton of money on aesthetics but the plumbing was shoddy. And now, we will have to pay a significant portion. So annoyed. I heard it's realllllly hard to get recourse.

@Foodnerd81: I hear you :/ we had a window installed crooked and it was like pulling teeth to get it fixed. Everyone said it was someone else's problem. So depending on the cost of this, I would just fix it for a timely resolution.

@gotkimchi: no it's that the entire tile work is terrible and leaks throughout. They definitely just painted over the damaged ceiling underneath but there is no way they were showering in there without it leaking. So perhaps THEY could have gone back to the contractor who built the shower.

Really not the end of the world, luckily (thinkignof our fellow bee with the brown recluse spiders!!) but it sucks.

If it was repaired and they thought it was fixed I'm not sure that's a problem? In my state we wouldn't be required to disclose that. Only major defects, shower repair wouldn't qualify. Particularly since I'm guessing you can't prove they didn't know it wasn't fixed. They could provide proof of repair and then I would imagine they thought it was taken care of. Although if you call them and ask who did the work maybe you could have some recourse with the plumber

Has anyone taken action against previous owners of a house for not disclosing significant problems in their house? DH is talking to a lawyer, though we really aren't hopeful. Just wondering if anyone has done t and how your experience was.

The issue isn't humongous- we need a brand new tile shower and we can now see it had been repaired a few times and they definitely knew about the problem (per a tile guy who came to fix the leak). We are pretty sure even if we sued and won it wouldn't be worth the time and money though.
