<description>&#60;p&#62;@2PeasinaPod:  my understanding (from talking to HR) is that if you have vacation time, your STD time clock will still start running 1 week after birth, you just don't get paid for the STD. So if i have 3 weeks of sick time and 6 of STD, I'd get 1 week of paid sick, then 2 more weeks of paid sick while disability is 'running' but I'm not getting paid for, and THEN, 3 weeks of getting STD pay. I intend to call Aflac to verify this because it seems fishy to me too.

<description>&#60;p&#62;For my company, STD ran concurrent with FMLA. Once my STD was up, I had to use any time off that I had accrued concurrently with my FMLA. Lucky for me, I gave birth at the end of September, so I was saving all of my vacation days specifically for my unpaid FMLA time. &#60;/p&#62;
&#60;p&#62;@LazyLightning:  The fact that they are making you use your vacation concurrent with your STD isn't right. I would double check that with your HR department as I  was sure that they couldn't let you burn vacation while on disability. FMLA, yes, but not disability.

<description>&#60;p&#62;I am not a lawyer.  I did investigate all of this when I got pregnant.  If you have a nice company they may let you do STD and then FMLA.  But legally you only get 12 weeks and you can use STD for 6 of them.  Also, you are allowed to elect to use your own leave during FMLA if you want to get paid.  Your company is also allowed to require you to use all of your leave during FMLA. <description>&#60;p&#62;They actually address different things - FMLA protects your job for and essentially says that they have to provide you with &#34;like&#34; employement after you're out for 12 weeks (doesn't have to be concurrent).  Doesn't have to be the same job, just a similar job I think.  So you can take 6 weeks off full time and then do 12 weeks at half time and that still counts as 12 weeks total.  It pretty much allows you to be out for 60 workdays in the course of a 12 month period and not be penalized.&#60;/p&#62;
&#60;p&#62;STD is insurance that pays (usually a %) of your pay for a certain amount of time that you are out sick or injured or recovering from a procedure (in this case you are recovering from childbirth).&#60;/p&#62;
&#60;p&#62;That is why these things usually run concurently - they really have two separate goals.  FMLA - job protection, STD - pay coverage.

STD is where you actually get paid for your time off.  Usually, you only get 6 weeks STD for a normal vaginal birth (if there are other complications you can get more time off) and then you are on unpaid FMLA for the remaining time. &#60;/p&#62;
&#60;p&#62;I had STD for six weeks at 60% pay, however used my PTO bank to make it 100% pay, then had six weeks unpaid of just the FMLA.

I only have to use 1 weeks of vaca/sick time during the 'waiting'week before STD kicks in. So at least I'll come back to a couple weeks of vaca/sick time still to use for the year.&#60;br /&#62;
I'm in PA if that helps.&#60;br /&#62;
However, I am a little unsure if the 12 weeks of FMLA is additional or if it's just another 6 weeks added on.

<description>&#60;p&#62;For me they run concurrently.  I'll &#60;i&#62;supposedly&#60;/i&#62; be able to use my sick and banked sick time in order to be paid 100% during my six weeks of STD, and then I'll use my vacation to cover the remaining six weeks of FMLA that is normally unpaid.&#60;/p&#62;
&#60;p&#62;At my company, we have a Leave Manager who manages all FMLA, STD, etc.  This is different than our HR department, though the HR department was able to give me the number to call.  When I called and told them I was pregnant and looking for FMLA, they automatically added STD to my leave as well.&#60;/p&#62;
&#60;p&#62;I'll have more information once I actually have the baby and find out how it all really works!  Currently all my leaves (FMLA and STD) are &#34;pending&#34; and don't kick in until I actually give birth.  I have no idea how it will actually work at that point... hope it's fairly straight-forward!

FMLA is just an administrative policy that says you're entitled to take leave, but it doesn't specificy if that leave has to be paid, unpaid, partially paid, etc...  STD doesn't guarantee you the time off; it just pays you if you qualify to take time off.

&#60;p&#62;FMLA is only a 12 week unpaid leave.  The STD just made sure that I would get up to 6 weeks of paid leave**, after I used all of my accrued paid vacation and sick time.  It doesn't extend the length of your leave.  &#60;/p&#62;
&#60;p&#62;Since I had DD in January, I didn't have any vacation accrued, but I had 4 weeks of sick time.  After those 4 weeks, the STD kicked in and I received money.  &#60;/p&#62;
&#60;p&#62;**The &#34;6 weeks paid leave&#34; had a 2 week waiting period, so it was really only 4 weeks of pay.  &#60;/p&#62;
&#60;p&#62;I'm not sure how well I'm explaining this, but let me know if you have any more questions - it took me a while to wrap my head around it.
