I'd rather our legal system where there is a presumption of innocence requiring the government to prove its case "beyond a reasonable doubt rather" than one where the State presumes guilt and the accused must prove otherwise. </p> <p>That said, she will have to prove that she was mentally incapacitated that she couldn't literally understand what she was doing when she committed her crime (under NY law anyway). Like really people, if you get mad and kill someone you are not insane. You made a mistake, although a horrible one, it was a mistake and that does not make you legally insane.
