Sounds shady. That would mean he was doing something illegal when he renewed your lease....

Yeah, it sounds shady to me. I wouldn't want to move since you are so close to your due date.

@googly-eyes: I have 6 days to my due date and the baby could arrive any day now so we are definitely not going to BEGIN packing now. It would be a different story if we knew ahead of time we were moving and had packed everything already.

We have just decided to stay put for now.

I know in some places it is 2 people to a bedroom, but the living room can be counted as a bedroom as well. I don't know where you live though.

That said, you did originally want to move..are you absolutely sure you don't want to move now? We are in your situation as well. (Our one bedroom lease is up a couple weeks before my due date!) If you really are sure I'd say what you're doing is good- ask for what law you're breaking and why they let you sign a contract to begin with?

Sorry you're going through this. Hope it all gets sorted out soon..

That sounds so shady and you already have a signed lease for the next year. So why did he let you sign that lease if it breaks the law? Apparently it didn't break the law when you signed it but now that there is a 2bed available it is breaking the law? It doesn't make sense.

Housing laws are 2 heart beats per bedroom. It does not matter age or sex. So since it is a one bedroom, you have one person to many.

Yeah we will ask him which specific law we are breaking and if we can see it in writing and we will just stand our ground and stay in this one bedroom til our lease is up

I definitely agree with PPs. Maybe if you demand to see the housing laws he is talking about he will leave you alone? I say that because it shows you aren't going to just do what he says.

Yeah, that doesn't sound right to me. I've never heard of it being against the law for three people to occupy a one bedroom apartment. If so, I think the entire city of Manhattan would be evicted!

I would tell him that you signed a 1 year lease on your current apartment and you're staying unless he shows you proof that it's against the law or starts eviction proceedings.

I agree with previous posters about not letting management bully you into something you've already agreed to. Plus, LO is not going to take up much space for the 1st year. Stand your ground!

I would ask him for documentation regarding the law that forbids 2 adults and 1 child to live in a 1 bedroom apartment. (I'm thinking he's referring to the laws of the complex because it's got to be impossible for that to be housing laws.. if so a LOT of my friends should have been evicted!) If he is able to produce that, then bring up the fact that you signed the lease (which is an agreement WITH the complex) with them aware of the fact that during the duration of the lease you would have a 3rd occupant joining you in the 1 bedroom apartment, so that lease should be void. Then move the hell out of that complex because they are definitely being shady.

Check the rental laws in your area! I would bet that he has someone ready to take your 1-bedroom that doesn't want the 2-bedroom, so hes trying to pressure you into it.

I would just tell him that you're not moving and if he wants to force it to a legal issue you're not at all concerned considering you have a binding lease agreement in place! He's just trying to use scare tactics to get a bigger rent out of you, so don't let him push you around.

Uh. That's totally shady. And how is it against the law for 2 adults + a baby to stay in a one bedroom apt? (I don't know!) I would ask him to show you the housing laws that state this.

we currently live in one bedroom apartment. And had originaly expressed interest to the managment in getting a 2 bedroom at the same complex once our lease was up this month, however they didnt have one available and we didnt want to move to a new complex altogether especially since our lease was going to expire around the same time as the due date of the baby and would involve too much work. so we went ahead and renewed the lease for one more year in this one bedroom place.
Just this week though, the manager of the apartment notified us that they now have a 2 bedroom apartment available and from what DH said he is trying to force us to move into the 2 bedroom claiming that its against the laws for all 3 of us (DH, me and the baby on the way) to be in a one bedroom apartment. But I have less than 2 weeks to my due date and we have already set up everything for the baby. we are not in any position to begin packing and moving now, plus we already renewed our lease here for another year. They allowed us to renew the lease for another year, knowing we had a baby on the way when they didnt have a 2 bedroom available but now that one suddenly opened up they are trying to push us to take it. What would you do in this situation?
