I had an issue like this with another retailer (Horchow) where I had to keep calling and at some point I said, "the next time I call, is it going to be backordered again?" So I canceled it and a year out I saw that they decided not to ship the item to anyone because they never received it from the manufacturer.

Do you have Amex by any chance? If you do, one option is to dispute the charges for the 1st part of the order that you received. Although you assembled it, they're really good about getting you a refund for that stuff. If you don't, I'd go with Mamamoose's suggestions.

Also, since your goal would be to either have all of it or none of it rather than have half of a free office set, it might be worthwhile to a thorough search to see if this is really exclusive to Sears or if anyone else carries it. They may not be able to rush it to you either (since the holdup might be on the manufacturer's end), but they might at least have better communication about how you can get ahold of the set from them.

My Dad had an issue with a mower with them many years back and he kept asking for that person's manager and the next person's manager until he was actually on the phone with the CEO. No kidding. He had the lawnmower blade he needed the next week.

Consumerist also often has addresses of execs if you want to email the C suite... cc'ing them on things often gets things done!

@MamaMoose: right....pay me (the 9 month pregnant lady) to disassemble the desks, buy huge boxes and ship your stuff back....OR let me keep it all and refund me.
I'm not a lumber jack...It's not like I'll benefit in ANY way what-so-ever from keeping 1/2 of a desk.

I'm with your husband. I would tell them that if part two hasn't shipped by Sept 25th you want a full refund on part 1 and they can either let you keep it, or they can pay you for ALL of the costs associated with having it assembled and returning it to them.

Based on my experience dealing with Sears, I would be fighting this all the way up until you have Part I refunded as well.

If at the time of delivery of Part I you knew this would happen you would not have assembled it (or paid to have it done!) nor would you have even purchased part I without II. To me it doesn't make sense why they split it on you, and now of course they have left you with half of what you wanted (you obviously bought it with purpose) and you're halfway invested into half of what you want. Get up to the higher ranks with them, you'll hopefully get a good reaction, I find with Sears the lower ranking staff only make their and your life more difficult seeking help from higher powers anyways.

@Thehistoryofus: omg are you my husband? He just said those same words. I guess you guys are on to something! I think that's what i'll attempt this week.
Project: : "get my money back so I can move on" underway :)

but PSA on Sears.com: they customer service is .....frustratingly disrespectful and very slow.

@TurtleDoves: I think you just ask for a full refund for Part 1 and tell them they can come and get it if they want it back (aka they send someone to disassemble, box up, and return).

@Thehistoryofus: At this point, DH wants a full refund on part 1 without returning it. Mind you, it would be $200+ to return it and we'd have to disassemble it. Shipping + boxes + money lost on handyman assembly = at least $300. This is a real wood hutch, desk and cabinet.

@chopsuey119: Yes, unfortunately part 2 contains the drawers of the desk and the shelves of the hutch and the cabinet doors of the filing cabinet! UGH! So upset :(

Does part I need part II or can you do without part 2?
I would call, complain, demand that they refund and pick up part I (if it's incomplete without 2). Or i would ask for a partial refund on part I for the terrible customer service and inconvenience.
Speak to a manager!

Wow that would really upset me. I would start making a stink about Part 1 of the order as well and let them know that you want to return that portion as well because its not what you wanted if you can't get Part 2 by x date.

To make a super long story short:

We order an entire home office collection from Sears.com

We had to order the collection in 2 halves. So, we did and we got the first half about 10 days after we ordered (in January!).

Then we waited for the 2nd half...it never came...we called 1,000 times and in May (5 months later), they finally take us seriously enough to tell us that the 2nd half of our order if backordered until Sept.9
We make a huge stink about their lack of communication skills and they refund us 1/4 of our price as a courtesy.
So, on Sept.9 they were supposed to ship us part II of our order.
Never happened.
I call today and its back ordered until Sept 25th and even then, they can't guarantee we'll get one because there is a line.
"Um, should't we be first in line seeing as we ordered 9 months ago and you charged our credit card?!"
So they reimburse our credit card and say "we won't charge you unless you're lucky enough to get the 2nd half of your order".
OK so now we're stuck with part 1 ($1000) and crossing our fingers for part 2 ($1250).

We can't return part 1 because it's already assembled (and we paid a handyman for that too). We're loosing money left and right on this thing!
