@sotofamilia: @truth bombs: @pancakes: @iced tea: me too! I am ever so hopeful to have hot water when I get home tonight!

My husband just texted..."there are two guys here for the water heater. They said the boss is also on his way." So, it sounds like the owner is paying a visit. I replied "whelp...guess it will be done right this time." ha

@Caly: In my opinion it wasn't just "overlooked," it was a
grossly negligent mistake. Even if you can afford it, $300 isn't just a drop in the bucket for a lot of people. I would absolutely call the owner if the management doesn't resolve it for you.

@sotofamilia: I just got off the phone with the owner. I didn't ask for him, I was transferred to him when I told the tech I wanted to speak with someone about the cost. I told the owner that while $320 (was actually going to be more like $450) isn't a ton of money, it's the principle. The work wasn't done properly and I don't feel like I should pay to correct their mistake. I would have happily paid for the work to be done last year, but now I'm unwilling to pay more. I also told him all week I've been taking ice cold showers and boiling water for dishes and to bathe my children. Needless to say, he apologized and said there would be no cost.

@Caly: I'm sorry, but they didn't estimate and/or complete the job properly a year ago, and now think they are going to charge you as if they did? This should be comped for the inconvenience/potential safety issue.

I mean, I'm a pain in the ass like that, but I would call the owner. I would want him to know this was going on, if I were him. This might be a case of the office manager or whoever following the letter of the law and not the spirit.

What a hassle. It might be a small amount of money, but it would really bug me.

@sotofamilia: they aren't saying it happened since last summer. They admit that it wasn't vented properly when they installed it and that it was "overlooked." He said that because we would have paid for the cost of the extra venting last year it's basically no different paying it now instead. Yes, we would have paid the extra last year, HAD you done the work properly THEN. In my opinion, now you pay for your mistake.

Turns out my longtime co-worker is good friends with the owner (went to school together/introduced him to his wife). He gave me his number and told me to give him a call & that he wouldn't be pleased with what's going on. If I'm not happy with the resolution, I'll give him a call. I generally am not a fan of playing that card but will if needed.

So we own a similar company, and I cannot imagine charging a customer in a situation like this - if the company messed up, the company has to fix it.

Are they saying this has happened in the time between when they installed it and now? I don't understand how they feel justified to charge YOU for their mistake?

They need to be doing the work for free, apologizing profusely, and hoping you don't take it to social media.

@Truth Bombs: I love this idea - don't give them more money! Definitely let them know that if they won't make it right you'll be hiring somebody else to fix it because you don't feel comfortable paying them extra to fix something they screwed up in the first place.

Well, if they resist doing it without cost to you, you can always hire another company to fix it then file a claim in small claims court. That would cost them more money, no doubt. Or better yet, just use this threat to make sure they fix it at their cost.

I would check your contract/estimate. Who was responsible for the permits? The venting is a safety issue. It sounds like they didn't do it up to code, which would be concerning if they were licensed. I would specifically ask the owner/rep from the company why their work wasn't up to code. If it wasn't comped, I'd probably mention it on Yelp.

Threatening a law suit over a $320 fix would be an overreaction and not worth the cost of the lawsuit. However, I would absolutely work your way up the chain of command and demand that they correct the issue at no charge to you. If they won't do so, I would not pay them, I would call another company to do the fix and I would be writing bad reviews of the original company everywhere I could and I would let them know of my intention to do so.

@Mrs. Lemon-Lime: I did express my disapproval when I spoke to the guy who will be coming out (don't think he's anyone in a position of authority though) and told him something is going to need to be worked out since I believe it should have been done correctly last summer.

@2littlepumpkins: the need to have it inspected was never discussed with us. If it was, we would have had it done!

@synchronicity: exactly, that's why you hire professionals, to do it properly! I wanted to make sure I wasn't out of bounds to insist they cover it. That my head isn't being clouded by all these ice cold showers! :silly:

I would be pretty pissed and willing to take it as high as possible in the company to not have to foot that bill. They didn't do the job properly, how is that on you? I have a lot of family in the trades and I strongly feel that this should be on the company that installed.

@Caly: I would have guessed it was the owners responsibility to actually do the city inspection (but they should notify you of the requirement and that they don't do it) but I definitely would make a stink about paying for the labor and any materials beyond what you would have had to buy anyway.

Last summer we had a new gas water heater installed by a very reputable local company. We were replacing a tankless water heater with a tank since we aren't sure how much longer we'll live there and didn't want to invest more into the house. On Monday new meters were being installed in our neighborhood and in the process they realized our water heater hadn't been installed properly and turned off our gas until it's fixed. Basically, the company hadn't vented it properly (carbon monoxide risk) or had it inspected by the city, which is required. The company is coming out tomorrow to fix it and said it would be approx. $320. It isn't a huge amount of money but I feel as though they screwed up (he said he didn't have an answer as to why it wasn't done correctly, that it was "overlooked") and that we shouldn't be responsible sine we had hired them to do a job they didn't do correctly and also put our family at risk. My husband is ok with paying for the materials but thinks we shouldn't have to pay for the labor. Am I out of line to think we shouldn't pay for any of it?
My teeth are still chattering from my ice cold shower this morning.
