<description>&#60;p&#62;@Boogs:  Yea I think the fact that the doctor made a huge clear error that clearly led to the pregnancy negates any assumption of risk she signed. Otherwise it would be like signing an assumption of risk to go skydiving and when it's time to jump the company gives you a backpack full of rocks rather than a backpack full of parachute. Yes skydiving is dangerous, but when there is gross negligence I would think (hope) it would override.

<description>&#60;p&#62;It's 100% human error, not nature finding a way. I don't think doctors should be sued for typical procedures where they did it correctly and they get pregnant anyway, but this was a clear mistake on the part of the doctor. &#60;/p&#62;
&#60;p&#62;So I do think she deserves to win. The doctor needs to be held accountable for a pretty enormous screw-up.

<description>&#60;p&#62;I haven't had a procedure like that done, but for that and the same when men get snipped, even if all goes 100% correctly isn't there still some super small chance that a pregnancy can still happen? And as a result you have to sign something saying you understand the risk? &#60;/p&#62;
&#60;p&#62;In her case she at least seems to have a malpractice lawsuit since he didn't correctly perform the surgery correctly, but I'd bet there was some sort of consent form she signed that would make it hard for her to win daycare costs. It will be interesting to see how it all plays out!

<description>&#60;p&#62;It sounds like the suit is valid and the doctor messed up big time (from the one sides article if course). So reasonably it makes sense to have the law suit but tell that to a ten year old who finds out they were a &#34;wrongful pregnancy&#34;. I'm not saying they shouldn't have sued but that is going to hurt the girl, even if they explain it.

<description>&#60;p&#62;I see no problem with the suit. This was not a case where the doctor acted reasonably and she was just one of the rare ones who get pregnant anyways. The doctor made a HUGE mistake. Like, a &#34;we learn in kindergarden that the LEFT hand makes an L with the thumb and pointer finger&#34; type mistake. And there are serious financial ramifications resulting from his huge, obvious, don't-need-a-medical-degree-to-tell-left-from-right mistake. This is what malpractice insurance is for. I get that doctors are human, but when they make big stupid obvious mistakes, their patient deserves to be compensated.

I just hope that the mother will tell the kid that he/she is a miracle and how blessed/thankful she is that he/she came into the world even tho it was extremely unexpected! I think if the mother can explain this the right way, that she sued mainly to get financial help or something, then hopefully the child won't take it the wrong way!

<description>&#60;p&#62;I find this very sad... But its my understanding that if you have 2 tubes and one ovary they should both be tied? I've heard that tubes can flip sides and catch eggs if needed. Of course its much rarer, but possible. Either way, the doctor definitely botched it.

I understand her wanting money to help pay for the medical expenses (the baby has sickle cell) and for child care.&#60;br /&#62;
At the same time though, it breaks my heart that this baby is probably going to someday find out that her parents sued for &#34;wrongful pregnancy&#34;. That would have to hurt. &#60;/p&#62;
