We currently have 5 frozen embryos. They would be donated to science should (God for did) we get divorced. I couldn't see using them with a new partner (to have a child that would be biologically my ex's). In the case of death, we did leave the option to use them should one of us pass away.

@bluestriped bee: I don't recall the exact language used on my form, but it was clear that allowing embryos for medical research was something entirely different that donating them to another couple.

@Shutterbug: LOL, I was thinking the same exact thing! Last night I actually said to DH during conversation that something was a "moo point." Heh

@bluestriped bee: In the situation of divorce we agreed that they would be transferred to me. I don't know if I would actually use them but I felt that I would want the opportunity to make that decision at that point. Donating to research was an option on our form with a totally separate option to donate them to another couple.

The clinic did point out to us that although the forms are on file they would likely not stand up in a court of law and that the clinic does it more to protect themselves than my SO and I

We had more than those three options to choose from. We chose that it would be decided at the time of divorce and written into the documents. Our other choices included one partner getting them, donating to science, donating to a couple, or discarding.

Hmm.. I need to ask my husband about this. He did IVF with his ex-wife and I'm curious what they did. If they had any that made it to freeze.

I think if we were in this situation right now I would like them donated to medical research.

We donated to science too. That was our eventual option, so it made sense for it to be the divorce option also.

Random question, but presuming one partner is designated to keep the embryos and a child results, are provisions made regarding custody and child support etc? Or does the child "belong" to one parent the same way the embryo did? Just curious if the forms cover these kinds of issues.

I checked back over our consent forms, and there was no divorce mentioned in there for some reason. There is death mentioned and we decided that we would let the surviving spouse decide what to do. We also checked off that we would want to donate any embryos that we didn't use to another couple needing embryo adoption.
