I think states rights are slightly varied. In my state it is legal to NIP without a cover, but there is debate own what is a public place (for instance, target).

@rachiecakes: it means if you are permitted to be there not breastfeeding, you can be there if you are breastfeeding.

The Texas law should be more clear. My state elaborates on it.

@Maysprout: That would be one of those times that a "lack" of clarification *is* the clarification... had it specified covered than the legal rights would only be for those covered, since it doesn't specify it doesn't pose restriction.

Kind of lack if a state had NO breastfeeding laws... that doesn't necessarily make it "not" legal.

As for CPS... I know they do some great things to protect some children that need it, but I've also seen first hand that they step in & take children from loving homes & parents. 10 years ago there also weren't legislation that separated breastfeeding from "indecency" so it likely was just seen as the same thing. Glad that's starting to change... well starting FB has blocked numerous entities & individuals for posting nursing pics (including the leaky boob founder) as "pornographic material". Mind you you can find ACTUAL pornography on fb pretty easily.

@septemberlove: especially nothing sexual when your nipples are sooooo sore from your baby's teeth and the last thing you want is for DH to touch you there!

@MrsH: That's like if a states didn't have *any* breastfeeding laws.... unless there is a law/restriction against it cannot be assumed "illegal" or not "permitted". It really is one of those instances that a lack of clarification is what permits it.

I would imagine though that IF it was necessary to be covered that the times that the police were called to breastfeeding "incidences" that something would be done against the mother.... there never has been though (there's actually been a number or breastfeeding incidences in Texas over the last couple years..... remember the Target nurse in? yea that was from an incident in Houston. lol)

@septemberlove: I agree & I'm a firm believer in breastfeeding AROUND children being incredibly important for our future generation of parents & adults! They should have a correct view of breasts, that there is an actual purpose for them AND that there is nothing "wrong" with breastfeeding. I remember when I brought P home & DH's niece (who is a year older than G) was asking me what I was doing & "milk comes out of there?"... it made me sad that this young girl had NO clue what her body is designed to do... and it's really so sad that there are men AND women that still thinks it's "gross"... I want my daughter & my sons wives to have support & proper perspective! I have always nursed around G & it just makes me feel really good that he'll be able to properly support his wife one day & not be "clueless".

This just happened in Knoxville. A nursing mom was asked to cover up while nursing in a Chick-fil-a play area. CFA backed down, and said it would refocus on properly training employees about the issue. There was a nurse-in today, I think.

Happened on an American Airlines flight recently, too. A 12 year old girl nearby the nursing mother was even reseated for her "comfort." Needless to say, they've lost some significant business and a nurse-in is scheduled.

What drives me nuts, is that any sexual purpose of breasts is secondary, the same way that any sexual purpose of hands and mouths are secondary, yet we don't need to cover those when talking, eating food, gesticulating, etc. The only thing obscene is that people seeing someone nursing imagine other things, and that is their own problem. Using breasts for their actual, intended purpose, should be the most comfortable and accepted (and respected) thing in the world--it certainly is one of the most ancient.
