Hi all.... I think we will be getting a nanny and we are trying to navigate what to do if one of us (her, DH, me, kids... lots of people involved) gets exposed to covid or has to quarantine. (I am a teacher. One son will go to outdoor pre-k. Here in NY infection is very low... for now).
She purchased a contract but it was extremely confusing and almost too comprehensive.
What are you doing with your nannies in the case of quarantine/ exposure? She´s very reasonable about things.

We are considering something similar. I actually drafted it yesterday and am waiting for my husband to review it. I documented expectations for behavior and cases where quarantine might be necessary, and for how long. It's all based on CDC guidelines. The three possible events are coming down with symptoms of COVID, being diagnosed with COVID, or coming into close contact with someone who has COVID.
If one of our family members gets sick then we will pay her as usual. I added an extra two weeks of "COVID sick pay" for her to use in case something happens to her or a member of her household due to the above. This is on top of the usual paid time off that we offer.

This is somewhere that being on or off books might be important and whether or not she carries health insurance and what type. If she gets Covid, and thinks she got it on the job at your house, what if she gets really sick? Do you have workers comp or some type of liability policy in case she comes after you to recoup the costs of her medical bills? Can she claim short term disability? Will you (can you?) absolve yourself of any liability? She might be reasonable about things now, but if she’s in the hole for thousands of dollars, people tend to become less reasonable. Some of these things are only possible if someone is on the books.
I ask bc a friends nanny was hospitalized for several weeks with covid. The whole shebang: intubation/sedation/weeks of rehab. Still cannot work at this point.
Eta: if this is a full time job type thing, I’d consider consulting a lawyer. I know that seems crazy..but 2020 is crazy.

Here's the big things I would cover:
- if she's showing symptoms, she needs to get a test. Who pays for it? (The doctors visit and test).
- if she's symptomatic and you are awaiting a test, does she need to quarrentine? Do you pay her while you wait for the test?
- if she has it, what are the requirements for her coming back to work? If it's a negative test, will you pay for the retests? Will you pay her for the 4+ weeks she's off?
-if you're asked to quarrentine due to exposure, do you expect her to come? What is your testing and payment approach?
-if your kids are sick, but are unsure if it's COVID, will you ask her to come while you await test results?
It sounds like a lot, but these are the big HR questions we are seeing.

@Littlebit7: Not to threadjack but what a mess... We have our occasional babysitter come to help out some and we haven't had contact with anyone outside our household besides her since March so I'm not really worried about getting her sick. She's also in her 20s and healthy, and super sweet, and I believe has health insurance through her other job, though I don't know for sure... But still this kind of freaked me out. If a babysitter thought you got her sick, could she sue?

@periwinklebee: I’m not totally sure. We got an umbrella policy last year after we bought our house and the framework of it protects us if we get sued; now that we own a home and have more assets as we get older and save...it seemed like a no brainer to have some protection in the event we get sued. People are nuts
I think it might be hard for someone to legit prove they got Covid at your house. But if you have a full time employee such as a nanny, and they get injured on the job, or your kid gets Covid and then surprise, nanny tests positive, they could definitely try to go after you in the event that things go downhill. Maybe a legal bee could Chime in here.

@Littlebit7: thank you!!! this is a good point on liability insurance, I've got to go back and check what our umbrella policy is, and maybe up it... as you say, a good idea in general.
