Could someone help me understand how this would work.
In my area, the child ratios are as follows:
12 months to 19 months: 1 to 4 ratio
20 months to 3 years: 1 to 6 ratio
LO is 18 months, and i know that half her class is 18-19 months, and the rest at least 20 months. This morning, DH noticed that there were 6 kids in the room but only 1 caregiver.
Shouldn't there really always be 2 caregivers?

Are there mixed ages in each room?
Our day care does it by room not ages for the ratio.....

In my state, when there are mixed ages you need to go my the ratio of the youngest child in the group. So, in that case, there should have been 2 teachers. Can you look into your states regs online or ask the director what their classroom ratios are? Or maybe the info is in a parent handbook you have?

It doesn't make sense that they have an age limit for the ratios if they aren't separating the kids based on their age. I definitely agree that as long as there are 18 and 19 month olds in the room, the need to follow the 4 to 1 ratio!

@Smurfette: It goes from 12-17 months for room 1, then 18-24 months for room 2. But i have a friend whose daughter is moving up to LO's room at 16 months. I think there should have been 2 caregivers in the morning.

Also, I am not sure if this answers your last question, but someone should be able to be left alone as long as they are in ratio with the number of children they have. So, if there were only 4 kids, there could be 1 teacher.

@Freckles: at my daycare, they do the ratio by room. so the ratio is 1:3 in the infant room (babies under 1 year old). the ratio for the infant 2 class (babies from 12-18 months) is 1:4.
they are pretty consistent with staying true to their ratios but there are some days where the ratio may change due to staff shortages or babies being dropped off earlier/later than usual

Is it the ratio the law? Or the day cares?
I know in GA for infants it is 6:1 but our center is 4:1, so if there some time with 5:1 legally it is still ok.

Also, the daycare I work at has classrooms separated by age group, but there are times in the opening and closing hours where classrooms are combined because there are only a few kids. For example, the 1 yr olds and 2 yr olds might be together for 30 minutes until there are more kids and staff present for the day. In those times, we go by the ratio of the youngest child in the room.
ETA: DPW should be what they are following for your state's ratios.

You need to check the state regulations, because in Texas they go by the average age in the room. So if they averaged out all the ages and it was more than 20 months, they would be ok with only one caregiver. There are other rules about how far apart in age the oldest and youngest child can be too, but that wouldn't factor in in this circumstance.

Definitely ask the director. I have had issues with our teachers being lax about teacher to student ratios when they are outside for some reason. I too noticed this happens mostly when there are mixed groups of kids together (1s and 2s have the same play space outside). I spoke with the director and she made sure it was taken care of.
