Supreme Court about to release decisions on Prop8/DOMA!!!

    Haven't read anything yet, but YAY!

    @Mrs. Lemon-Lime: Yes, very disappointed in the civil right's decision, especially given many of the tactics used in the last election to curtail minority voting in many areas. I know Congress could act on this, but given the makeup of Congress that's extremely unlikely!

    Well, yay for California! Boo for them side-stepping the issue and not overturning all bans.

    But, overall yay! It's been a victorious day for marriage equality!

    @zippylef: One of my law student friends on FB just posted about Prop 8:

    "Legally, they [the petitioners] didn't have the right to bring the case as they would have had to show how same sex marriage was harming them in some way. The court ruled that they did not adequately do that. Therefore, dismissed"

    @zippylef: I'm not done reading the op, but they said the petitioners (the proponents of Prop 8) don't have standing to sue. You have to have standing in order to have a case that the courts can adjudicate. It's a legal prerequisite. The lower courts said they did and struck down Prop 8, the SCOTUS said they didn't, and threw out all the lower court opinions. The lower courts now have to dismiss the case.

    @yoursilverlining: Agreed. Yesterday's decision was very disappointing. I am happy about DOMA being struck down! The Court got something right!

    So happy about the rulings today! At least the supreme court rules correctly (according to me) in some instances.

    @zippylef: A complete explanation would take a couple of hours. The quick version is you have to show that you (the litigant) have suffered an "injury," and the Court here found the petitioners did not show that they had one.

    Just to correct my earlier post--the appeal below has to be dismissed as a result of this opinion. I think the original order not to enforce Prop 8 may stand. (But don't quote me on that--I'm reading fast!)

    @honeybear: Ah, okay. That makes sense! I read something about it being "vacated and remanded" back to the 9th Circuit Court? Which I guess had already ruled it unconstitutional, so is that what makes it now legal in CA?

    @zippylef: Yeah, so the 9th Circuit has to dismiss the appeal because the petitioners never had standing to appeal the case in the first place. The initial plaintiff in the District Court was the governor. He almost certainly did have standing. At the Dist. Court, the judge said Prop 8 was unconstitutional and ordered the governor to stop enforcing it. The governor then decided not to contest the case further and allowed the petitioners to step in to appeal the case to the 9th Circuit. That's when standing evaporated, according to SCOTUS. If the governor had appealed, this probably would have gone to the merits. (Merits = deciding whether Prop 8 is constitutional or not.)

    So thrilled!!!! I have never understood any objection to gay marriage that was not religion based and as religion has no business in politics, it really made no sense. Great day to be an American!

    @Mrs. Jacks: I agree with you - they absolutely made the wrong decision about the voting rights act! If only Congress was competent and socially aware enough to pass legislation that would address the issue (that still exists) today. With corporate personhood and Citizen's United, I was nervous about today's decision. I'm glad they got this one right.
