Could it be that they are a different style? Like cropped? Or are they literally the same ones but a different color? Then that would be weird!
It's never happened to me before, but I would return them.

I've had it happen, sometimes the tee shirts are a little narrower than others and they were in piles right next to each other. I know at my local store, it's an outlet, so they sometimes have "seconds" stock of stuff, so I expect it to be wonky.

I've had this happen with Baby Gap numerous times. Same style, same size - - except, not the same size! Very annoying.

@Bao: I had this happen with the exact same leggings!

In general I think their leggings run weirdly small compared to their pants, and the leggings don't even seem to always be consistent.

@Bao: That's a pretty big difference! I don't know if it's the case for these leggings (these look more like they were mis-sized, or that one pair is cropped and the other full length), but sometimes it has to do with how the item is manufactured. Manufacturers sometimes press/cut out the item from a large stack of fabric--so the cuts on the top of the pile are more precise than the cuts on the bottom, causing some irregularities amongst the finished items. (That's why I typically try on more than one item in the same size--one size 4 may fit differently than another size 4).

I haven't had this happen to me for Carter's (that I've noticed) but I'm not surprised. Lower end manufacturers (like ON) use essentially cookie cutters to cut their pieces, and cut out multiple pieces at a time, so the fabric on the top is cut one size, and the fabric on the bottom is cut slightly a slightly different size, even though it is the same "size" cutter. I'm sure carter's does the same.

I haven't had this happen at Carters, but I did at Old Navy with a button up shirt! Sometimes I wonder if maybe they sew/print the wrong sized tag on?
