Can a plea deal be overturned at a plea hearing?

With the caveat that I don’t really practice criminal law, my understanding is yes. That is more or less the point of the plea hearing when you’ve already reached a deal.

Same as above. I do civil defense work but I believe so.

@nwm: @wrkbrk: thank you ladies. The damn prosecutor weinered out on my husband's officer involved. He offered him 35 years. To someone that is a persistent violent offender that in one night alone executed a person, shot his girlfriend, shot at 2 cops, felon in possession of a weapon.
I'm starting on my victim impact statement, but it just feels like we've already lost.

@wrkbrk: we're coming up on the 2 year anniversary, I mentioned it a couple times on the POAS as hearings have come and gone... But not much of a dedicated post.

@Sams Mom: i'm sorry, that sounds scary and frustrating--but i also think victim impact statements can be super important. i hope it might make a difference and if nothing else that it gives you a chance to share your story with the judge.

Keep your fingers crossed or say a prayer, were going into the plea hearing for my husband's shooting.

. So he has to do 85% of 35 years for 2nd degree murder, two charges of 1st degree assault of a special victim, two charges of armed criminal action, one charge of 1st degree domestic assault, and felon in possession. I'm so pissed off right now

@agold: we don't live super close, but it's not far either. The only solace in this is he murdered someone much higher than him in the gang they're in; and my husband has heard there is a hit within the DOC on him. Sounds terrible, I know, but maybe there will be some form of justice come of this.
