Hello! Long story short, a family member of mine is out on STD for a broken bone. The break required surgery and lots of hardware. Said family member is receiving STD pay and still in physical therapy - has about 4 more weeks until person is up and about on their own and will have dr release to return to work.
Employer called yesterday and said FMLA was done tomorrow and either needs to return to work (out of the question considering member can barely stand/walk at this point) or send in a resignation.
Is this legal?? Member is still in the healing process and will lose insurance to continue therapy?!??
ETA: employer does not offer LTD
