I think his comment was really stupid but jail time? Some people (aka Celebrities and even worse criminals) spend WAY less time in jail (if any time) for the horrendous stuff they pull!

@Mrs. Lemon-Lime: I think this is a tough one. With all the crazed shootings these days, how can people distinguish between comments that are "just sarcastic" and comments that will lead to actions...

If they are concerned that he might be a threat, let a psychiatrist evaluate him rather than keep him locked up. Jeesh!

I think, with some follow up conversation, you could tell the difference between a sarcastic comment and a real threat. If it is part of a smack-talk conversation where the person says something ridiculous and then says LOL or J/K that is different than saying "I plan to ____" Like the difference between someone who says, "Man I just wish I'd die!" versus, "I am going to kill myself. I have a gun."
