So my husband and I caught a snippet of 20/20 or something about how some teenager got super drunk and tried to sneak into his house but was SO drunk he snuck into his neighbor's house instead and the neighbor thought he was an intruder and shot him. Which spawned a convo between my husband and I about whether or not the neighbor was justified and what we would do.

My husband said (assuming you have a gun anyways) you have an obligation to try NOT to shoot the person who broke in. You should wait until it is clear they are trying to harm you/your family and you should give a verbal warning like "I have a gun and I'll shoot you if you don't leave right now."

My opinion? You break into my house I'm shooting you. I don't think someone breaking in "accidentally" is all that terribly likely. And if you broke in on purpose, I don't know WHAT your purpose is. I don't know if you're trying to hurt me or just steal stuff. I don't know how you'll react if you get surprised that I'm home/woke up. I don't know if you'll freak out and shoot before thinking. I don't know if you're mentally ill or on drugs and might act irrationally. I have NO idea and no way of knowing how big a threat you are to me and my family. And I am not trained in home invasion/criminal-mind-reading. If this ever happened I would be scared out of my mind I'm sure and I don't trust myself to know when the last moment I could shoot would be before I get shot myself. I don't know if I say "leave or I'll shoot" that you won't turn around with a gun in your hand and open fire before I have a chance to react.

So yea. If I had a gun and you broke into my house? I'm shooting first and asking questions later. No question in my mind.
