I have been tossing around the Idea of an etsy shop for awhile but I had a question about licensed characters. I have seen a ton of stuff with super hero logos or disney characters. Is that legal? Or do people just do it hoping to not get shut down.

I am not positive but I don't think you are allowed to sell licensed material unless you contact the company and get their permission? Or maybe you can use really old characters that licenses have expired? Good luck w the shop!

There's lots of discussion on the etsy forums about it - my understanding is that its not legal but enforcement is rare and comes from the license holder and not etsy.

It is not legal. That's why they are "licensed characters." You have to get a license to use them (pay for a license).

I would say not to do anything with licensed characters, but that's just my opinion. I wouldn't want to get into any legal troubles.

That's what I thought. There were just so many out there that I was wondering if I was wrong. I bought some of the disney cartridges for the cricut cutter to make some things for my kids room. Then I saw tons of products on sale with those designs. Then I started wondering if you are allowed to use any of the cricut cutter things? Like if they are made from the non disney cartridges does that still run into copyright issues.

It's illegal. I make and sell dog collars and received a threatening email from Vera Bradley because one if them looked like a Vera pattern even though it wasn't. Not my fault Joann fabric was selling that pattern and called it "the Vera"

@oahujeni: this is what makes me nervous. I would think if you bought a fabric and made something with it, it would be ok. I was pretty sure the characters were illegal I was just surprised at how many people were selling Disney.

What if you bought a Disney/Hello Kitty fabric from Joann and made something from it?
I think I read somewhere that Stampin Up stamps are all licensed so that you can use them for things you sell.
