Yep, today. This is what he gets for pulling himself up by his bootstraps, being honest and hardworking, and refusing to kiss the... um... hand if his Godfather wannabe boss. So angry. What kind of person fires someone the day before July Fourth? DH said his boss was positively glowing with joy when he broke the news. And it looks like they've invented a cause of firing, so no unemployment for us. I guess we're one job away from being out of the house. Ugh.

Oh no.! I am so so sorry. You should fight them on unemployment. My sisters old job tried to deny her as well but then they didn't show up for the claim in court and she was automatically given benefits. If he has any emails he should save them too.

@Mama Bird: no! This has happened to dh... um... but about benefits- they almost always side with the employee so look into it! You can appeal!

We were in this situation back in January when my husband got fired. Most stressful couple months of my life and even though he found a new job not too long after, we are still barely making ends meet. Definitely still apply for unemployment, it's worth a shot.

@mrsmccarthy, greentea, littlecasita1122: sorry you can relate! I'm very relieved to hear we still have a shot at unemployment though. I've a feeling it will be a long job search - he's been trying to get out of there for a year and a half now, and no luck.
maybe now he won't mind starting his career from scratch to become a teacher

I am a lawyer and I work unemployment cases. I would strongly suggest filing a timely appeal and making sure you have a hearing. You may also want to contact your local Legal Aid Society for representation. Even if your husband is initially denied UC benefits because of what his employer reported, there is often no evidence to substantiate it once you get to hearing.
The laws vary state by state but in my state (which is pretty employer-friendly), you have to do something pretty egregious to commit "misconduct" and be ineligible for UC. A mistake is not enough - generally the conduct has to be intentional or recklessly negligent. You can google laws in your state to find out the exact language of the applicable statute.
I literally win cases for people ALL the time that would definitely lose if they had represented themselves and didn't know the law. Please fight it and call your local Legal Aid for help!!

I'm so sorry. I would call DOL. I don't get how he can screw your DH out of unemployment? Hopefully something new and better comes up soon!
@Mama Bird: also, I wanted to say, I got laid off while pregnant. And one of my old employers tried to contest my unemployment and I had to go to a hearing. So hopefully DH can contest whatever bogus reason they came up with.

@pastemoo: I think he can contest it - it was, in my opinion, a pretty innocent mistake. The only reason he's getting fired over it is that his boss was trying to find a reason to do so anyway.
@mrsads: thank you! We'll definitely do that. We're in New York and I think there's something in the laws about "good faith errors" not being "misconduct," but I'm not a lawyer so I could easily misunderstand that.

I do agree with others about fighting it. I'm pretty sure in NY misconduct must be "willful." An innocent mistake would not be included in that -- they'd have to prove it was purposeful.

I'm so sorry! DH was pulled off assignment from a company in February. By April, he was working with another company in the same building on the same floor and now they have the biggest office on the floor
His old company is really suffering but they have terrible money management issues. I'm surprised the three founders are still trying to keep it afloat.It will definitely be fine!
