Sperm donor has to pay child support

What do you think of this? A man responded to an online ad to donate his sperm to a couple but didn't go through a physician (I'm assuming because of the cost since the couple are in need of state assistance). He signed a waiver form of parental rights to clarify that he did not intend to be the father. The judge ruled that he now has to pay child support.

I think it's kind of sad...I mean, going through an online ad and and donating unofficially is very risky but I think the fact that he signed the waiver should mean that he doesn't have to pay child support!

I think it is ridiculous. Although I was at least glad to see that it wasn't the mother suing him (that would've made it seem worse to me-- like she just totally lied).

I can understand a PRESUMPTION that someone is not a sperm donor in the absence of very strong evidence to the contrary, but in a situation like this where there was an actual contract and both of the parties agree he is a sperm donor, it seems ludicrous to me that the state would make this guy pay.

Wow this is dumb. At first I thought the mothers were trying to get money out of him and I'm glad that wasn't the case.

FYI - The state of Kansas was seeking money for the public assistance that the stat provided (6k so far and any future need for the child born 2009).

@Adira: I think because they applied for state assistance, the state said, "where's the father?" And looked into it just so they can get the assistance? Or the couple went to court to get the assistance and somehow the contract of parental rights was pulled up? Ugh. Not sure! It was explained on the news a little better but still made me mad for the sperm donor.

@Adira: I am betting that someone that works for the state of kansas was just trying to save the state of kansas money (aka doing their jobs) by finding dead beat dads that were not paying child support. This probably popped on someone's radar... like hey... this kid that is getting assistance from the state has two mothers... where is the dad?!? It is a weird case... and pretty unfair.

And I agree - this totally sucks that they are making him pay child support when it's clear the intention by ALL PARTIES was that he would not be involved (and the child already has TWO parents). But they probably shouldn't have gone about getting his sperm this way either...

That's crazy! Poor guy! The mothers should have not told the state who the father was. Anonymous donor, or something.

I hope he gets it sorted out. Seems so unfair to a guy who was trying to help them out!

@Adira: obviously going through a clinic would've been way safer, for various reasons! However I'm assuming the reason they didn't was the cost (considering the fact the kid is on public assistance--- they must not have much money). Which then on one hand you can say well-- if you can't afford artificial insemination/to keep your kid off welfare then its best you just don't have a kid, and it is hard to disagree. But then on the other hand, straight couples can get pregnant without being financially ready for it all the time and no one can stop them, so it does seem sort of unfair that lesbian couples would have a financial competency test that straight couples don't.

@Dandelion: Near the bottom of the article I think they did say they didn't know who the father was... but they also accidently provided one of the contracts (it was confusing, I think there was one contract that was the agreement upon the terms of the transaction and another document that said he gave up his parental rights not sure which one they gave to the courts or if this was one document), and that happened to have his name clearly on it which is how Kansas figured out he was the father.

Sounds like a bad situation. The lesbian couple isn't together anymore, either. Too bad the state isn't going after the other mom for that money, and not him. He's not his dad, in my eyes.

@blackbird: that would make the most sense, they're the parents, not the sperm donor.
